Book Regulation and Compliance in the Atlantic Fisheries

Download or read book Regulation and Compliance in the Atlantic Fisheries written by Stig S. Gezelius and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a book about fishermen's reasons for obeying fisheries law. The fish harvesting industry has become subject to state interference to an increasing extent over the past twenty years. As natural resources become scarce and subsequent fisheries regulations abound, the question of law-abidingness is brought to the public agenda. However, there is still little empirical data as regards the dynamics of compliance in this field, and this book aims to meet a demand for in-depth knowledge. The cases studied can be regarded as instances of economies dependent on the harvesting of natural resources for both household and the market, and the study aims to contribute to the building of more adequate theory on the dynamics of compliance in such economies. However, focusing on a specific type of setting seldom constitutes a safe escape route for getting away from more pervasive sociological questions, and it certainly does not in this case. As any attempt to explain social phenomena, this study is faced with the fundamental sociological question of how the acts of individuals can best be understood. The question concerns the interface between the individual and the collectivity – between collective morality and self-interest. It thus deals with classical sociological issues such as the nature and regulatory capacity of group norms and sanctions, and the forms and roles of rationality and strategic action.

Book Making Fisheries Management Work

Download or read book Making Fisheries Management Work written by Stig S. Gezelius and published by Springer Science & Business Media. This book was released on 2008-07-15 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: The state of the Northeast Atlantic fisheries in recent years has highlighted - plementation as the Achilles heel of modern fisheries management: discards and unreported or misreported landings are in many cases recognised to effectively subvert sound conservation goals. Social science literature on fisheries mana- ment has tended to regard the implementation of resource conservation policies mainly as a question of effective enforcement. This literature regards surveillance and penalty as the key mechanism through which fishermen keep to catch restr- tions and loyally report their catches. This book emerged because several years of research on fishermen’s compliance had made us uneasy about this rather narrow approach to the problem of implementation. This uneasiness motivated us to widen the approach to the question of implementing conservation policies in the fisheries. Taking Norway as an example, its fishing fleet consists of some 7,000 vessels spread along a coastline of more than 20,000 km, populated by less than 5 million people. The idea of ensuring desirable behaviour through surveillance and - forcement alone is almost absurd in such a context, as the task is impossible by any reasonable means. The Norwegian implementation system has thus had to rely heavily on the incentives provided by the rules and legitimacy created through a century of state/industry collaboration. Different coastal states face very different conditions in terms of solving typical implementation problems such as discards and misreporting.

Book Strengthening International Fisheries Law in an Era of Changing Oceans

Download or read book Strengthening International Fisheries Law in an Era of Changing Oceans written by Richard Caddell and published by Bloomsbury Publishing. This book was released on 2019-04-04 with total page 512 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection addresses the central question of how the current international framework for the regulation of fisheries may be strengthened in order to meet the challenges posed by changing fisheries and ocean conditions, in particular climate change. International fisheries law has developed significantly since the 1990s, through the adoption and establishment of international instruments and bodies at the global and regional levels. Global fish stocks nevertheless remain in a troubling state, and fisheries management authorities face a wide array of internal and external challenges, including operational constraints, providing effective management advice in the face of scientific uncertainty and non-compliance by States with their international obligations. This book examines these challenges and identifies options and pathways to strengthen international fisheries law. While it has a primarily legal focus, it also features significant contributions from specialists drawn from other disciplines, notably fisheries science, economics, policy and international relations, in order to provide a fuller context to the legal, policy and management issues raised. Rigorous and comprehensive in scope, this will be essential reading for lawyers and non-lawyers interested in international fisheries regulation in the context of profoundly changing ocean conditions.

Book excerpt: The Law Library presents the complete text of the Fisheries of Northeastern United States - Atlantic Mackerel, Squid, and Butterfish Fisheries (Amendment 10) (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 NMFS is implementing approved measures in Amendment 10 to the Atlantic Mackerel, Squid, and Butterfish (MSB) Fishery Management Plan (FMP). Amendment 10 was developed by the Mid-Atlantic Fishery Management Council (Council) to bring the FMP into compliance with Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) requirements by establishing a rebuilding program that allows the butterfish stock to rebuild and protects the long-term health and stability of the stock; and by minimizing bycatch and the fishing mortality of unavoidable bycatch, to the extent practicable, in the MSB fisheries. Amendment 10 increases the minimum codend mesh size requirement for the Loligo squid (Loligo) fishery; establishes a butterfish rebuilding program with a butterfish mortality cap for the Loligo fishery; establishes a 72-hr trip notification requirement for the Loligo fishery; and requires an annual assessment of the butterfish rebuilding program by the Council's Scientific and Statistical Committee (SSC). This rule also makes minor, technical corrections to the existing regulations. Updated as of May 29, 2018 This rule implements approved measures in Amendment 4 to the Atlantic Herring (Herring) Fishery Management Plan (FMP). Amendment 4 was developed by the New England Fishery Management Council (Council) to bring the FMP into compliance with new Magnuson-Stevens Fishery Conservation and Management Act (MSA) requirements by: Revising definitions and the specifications-setting process, consistent with annual catch limit (ACL) requirements; and establishing fishery closure thresholds, a haddock incidental catch cap, and overage paybacks as accountability measures (AMs). In addition, the amendment designates herring as a "stock in the fishery;" establishes an interim acceptable biological catch (ABC) control rule; and makes adjustments to the specification process by eliminating consideration of total foreign processing (JVPt), including joint venture processing (JVP) and internal waters processing (IWP), and reserve from the specification process, and eliminates the Council's consideration of total allowable level of foreign fishing (TALFF). Book excerpt: The Law Library presents the complete text of the Fisheries of the Northeastern United States - Amendment 15 to the Atlantic Sea Scallop Fishery Management Plan (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 NMFS hereby implements measures approved in Amendment 15 to the Scallop FMP (Amendment 15), which was developed by the New England Fishery Management Council (Council). Amendment 15 was developed primarily to implement annual catch limits (ACLs) and accountability measures (AMs) to bring the Scallop FMP into compliance with requirements of the MSA as reauthorized in 2007. Amendment 15 includes additional measures recommended by the Council, including: A revision of the overfishing definition (OFD); modification of the essential fish habitat (EFH) closed areas under the Scallop FMP; adjustments to measures for the Limited Access General Category (LAGC) individual fishing quota (IFQ) fishery; adjustments to the scallop research set-aside (RSA) program; and additions to the list of measures that can be adjusted by framework adjustments. NMFS has disapproved a provision that would have allocated additional scallop catch to the LAGC fleet because it was not consistent with National Standard 1 and the ACL requirement of the MSA. This book was released on 2012-12-06 with total page 197 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the result of more than a decade's preoccupation with the issue of compliance in the Barents Sea fisheries, first as an interpreter in the Norwegian Coast Guard, then as a graduate student at the University of Troms0, and finally, as a PhD student at the University of Oslo and a research fellow at the FridtjofNansen Institute (FNI). Many of those who deserve a "thank you" in this preface have already been properly thanked on other occasions, among them my previous colleagues and superiors in the Norwegian Coast Guard. On the present occasion, I would particularly like to extend my thanks to the FNI leadership during my time here for giving me the trust and freedom to pursue my enthusiasm. Many other colleagues at the institute, from both the research and the administrative staff, have contributed to the present work. For fear of forgetting someone, I prefer not to mention names. There have to be a few exceptions though: From the administration, I would particularly like to thank Kari Lorentzen for her professional help in the library, and Ann Skarstad and Anne-Christine Thestrup for language assistance. Thanks to Claes Lykke Ragner for producing the map on page 7, and to Ivar M. Liseter for help in the preparation of camera-ready copy. Among the research staff, I would mention my long-standing fellow student and colleague both in the Coast Guard and at the FNI, Anne-Kristin J0rgensen.

Book excerpt: The Law Library presents the complete text of the Fisheries of the Northeastern United States - Atlantic Sea Scallop Fishery - Framework Adjustment 22 (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 NMFS is implementing measures specified in Framework Adjustment 22 (Framework 22) to the Atlantic Sea Scallop Fishery Management Plan (FMP), which was developed and adopted by the New England Fishery Management Council (Council). The specifications in Framework 22 are based on, and are being implemented in conjunction with, the management measures in Amendment 15 to the FMP (Amendment 15) that establish the process for setting annual catch limits (ACLs) and accountability measures (AMs) to bring the FMP into compliance with the requirements of the Magnuson-Stevens Fishery Conservation and Management Act (MSA). The purpose of Framework 22 is to set the following scallop management measures for the 2011 through 2013 fishing years (FYs): The overfishing limit (OFL), acceptable biological catches (ABC), ACLs, and annual catch targets (ACTs) for both the limited access (LA) and limited access general category (LAGC) fleets; open area days-at-sea (DAS) and Sea Scallop Access Area (access area) trip allocations; DAS adjustments if an access area yellowtail flounder (YTF) total allowable catch (TAC) is caught; LAGC-specific allocations, including access area trip allocations for vessels with individual fishing quotas (IFQs), the Northern Gulf of Maine (NGOM) TAC, and the incidental target TAC; management measures to minimize impacts of incidental take of sea turtles as required by the March 14, 2008, Atlantic Sea Scallop Biological Opinion (Biological Opinion); and the elimination of the default Georges Bank (GB) access area rotation schedule. Consistent with proposed measures in Amendment 15, Framework 22 sets FY 2013 management measures as precautionary default measures, to be applied if a new biennial framework adjustment is not implemented by the start of FY 2013. Book Market Denial and International Fisheries Regulation

Download or read book Market Denial and International Fisheries Regulation written by Darren S. Calley and published by Martinus Nijhoff Publishers. This book was released on 2011-10-14 with total page 300 pages. Available in PDF, EPUB and Kindle. Book excerpt: Flag of convenience fishing seriously undermines efforts to protect the marine environment. To counter this threat, Market Denial and International Fisheries Regulation rests on the logic of the most basic tenet of economics: if no market exists for a product then producers will cease to produce. Denying market access to the flag of convenience fishing fleet should significantly reduce instances of illegal, unreported and unregulated (IUU) fishing. In areas beyond national jurisdiction not only is market denial the most effective means of undermining the IUU fleet, it is, for most practical purposes, the only way to do so. To what extent, however, do the laws of the sea and international trade allow groups of States to close their markets to non-compliant fishing vessels?

Book Filling Regulatory Gaps in High Seas Fisheries

Download or read book Filling Regulatory Gaps in High Seas Fisheries written by Yoshinobu Takei and published by Martinus Nijhoff Publishers. This book was released on 2013-03-27 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Filling Regulatory Gaps in High Seas Fisheries, author Yoshinobu Takei investigates the regime of high seas fisheries from the perspective of international law and considers whether there are regulatory gaps in high seas fisheries and, if so, how they should be filled. The book focuses on topical issues such as the management of deep-sea fisheries on the high seas and the protection of vulnerable marine ecosystems. In view of the current state of marine fisheries resources, together with ecosystem concerns, swift and effective action is required to improve fisheries management, in particular for high seas fisheries. Takei thoroughly analyzes the current state of affairs and convincingly suggests steps to be taken in the future.
