It examines both the legal and policy frameworks pertaining to the protection of refugees in the region as well as the countries’ response to refugee movements from the Indochinese refugee crisis in the mid-1970s to the most recent developments. It covers important aspects of refugee protection, such as access to territory, non-refoulement, the treatment of refugees, the concept of refugee as applied in the region, burden-sharing and durable solutions to the plight of refugees. The analysis focuses specifically on the main countries of asylum within the Association of Southeast Asian Nations that are not parties to the 1951 Refugee Convention, namely Thailand, Malaysia and Indonesia. Using an international law perspective based on the doctrine of the ‘two elements’ (practice and opinio juris), the author argues that these states have long recognized that people fleeing persecution, armed conflict and generalized violence, namely refugees, should be protected. This in turn demonstrates that they recognize the existence and relevance of the international refugee regime despite their refusal to accede to the Refugee Convention. Offering a different perspective on the links between international refugee law and refugee protection in Southeast Asia, this book will be of interest to researchers and practitioners in the fields of international relations, international refugee law, international human rights law, migration governance and Southeast Asian Studies.

It considers how recent crises in refugee protection (such as the Syrian and Andaman Sea crises) have highlighted the strengths and limits of regional approaches to refugee protection and the importance of looking closely at the underlying norms, and the identities and activities of the relevant ‘norm entrepreneurs’ at the regional level. It compares the norms of refugee protection that have evolved in three regions: the EU, Latin America and the South East Asian region, to identify which norms of refugee protection have been ‘internalised’ in the three regional contexts and to contextualise the processes. The authors demonstrate the need for awareness of the roles of different norm ‘entrepreneurs’ such as states, international organisations and civil society, in developing and promoting basic norms on refugee protection. After the latest exodus from Myanmar in 2017, there are now more than half a million Rohingya in Bangladesh living in camps, often in conditions of abject poverty, malnutrition and without proper access to shelter or work permits. Some of them are now compelled to take to the seas in perilous journeys to the Southeast Asian countries in search of a better life. They are now asked to go back to Myanmar, but without any promise of citizenship or an end to discrimination. This book looks at the Rohingya in the South Asian region, primarily India and Bangladesh. It explores the broader picture of the historical and political dimensions of the Rohingya crisis, and examines subjects of statelessness, human rights and humanitarian protection of these victims of forced migration. Further, it chronicles the actual process of emergence of a stateless community – the transformation of a national group into a stateless existence without basic rights.

Book excerpt: This testimony focuses on two main issues: 1) the failure of Malaysia to respect its commitments under the Comprehensive Plan of Action (CPA) for Vietnamese asylum seekers, and 2) the need for a more vigorous US and international response to various refugee crises in South East Asia. In response to the 'Malaysian Pushbacks', the goals of the CPA are compared with the State practice which is said to fall well short of fulfilling the commitments of the States and, thereby, is putting the CPA at risk of unravelling. While the basic American position of involuntary repatriation is acknowledged, it is argued that the US has not done 'everything it could ... to bring pushbacks in Malaysia to an end'. As such, it is proposed that the US Government initiate: 1) consensus on repatriation; 2) new commitments on resettlement; and 3) new contributions of resources. To these ends, specific suggestions are offered, including: some compromise on non-voluntary return; adjustment of US Immigration and Naturalization Service policies regarding the resettlement of 'category groups'; increases in financial contributions to general and special programmes of the UNHCR, along with additional contributions for screening programmes in Malaysia and refugee assistance in the US. With respect to the other refugee crises in South East Asia, the testimony addresses the problems of piracy in the Golf of Thailand, forced relocation of civilians under Khmer Rouge control and other problems on the Thai-Kampuchean border, and aid and asylum for Burmese refugees in Thailand. Suggestions on appropriations are offered to help redress these problems.
