Kennedy, chairman, Alan M. Simpson and Paul Simon), hearing seven witnesses from both US state agencies and NGO's and reviewing several reports reproduced in the appendix (UNICEF, CARE, World Vision, US Committee for Refugees) tries to "understand (...) what the root causes are behind the refugee crisis in Southern Africa today, and what the USA and the international community must do if an even greater human tragedy is to be avoided". The countries of greatest concern are Angola and Mozambique which for the time being generate the largest numbers of refugees in Southern Africa which is likely to cause growing migration movements within the next years. Two features, it is stated, should characterize the Subcommittee's work: preciseness, and the will to learn the lessons from previous disasters. There are detailed evaluations of the numbers of refugees and of the staff available, the quantities of goods needed, the money and equipment available, the costs involved, etc. which allow to asses the actual material capacity of the US and the international community to help. On the other hand, there are the experiences made mainly in Ethiopia and Sudan in 1984, but also the current difficulties in Lebanon and Central America. They show that where civil strife or war (and not natural disasters) are at the origin of the crisis, the problems are not only logistical, but also political and tactical ones (for example: acceptance of the parties to establish "mercy corridors" in order to allow for the safe transport of food to remote areas, cease-fires for the protection of children and women, etc.). The Subcommittee seems to support the idea that there should be a UN regional coordinator appointed by the General Assembly, presenting the additional advantage of an explicit political backing not only of the donor nations.

It reviews South Africa’s approach to international migration in the post-apartheid period from a regional development perspective, highlighting key policy issues, debates, and consequences. The authors find at least three areas where migration is resulting in important development impacts. First, by offering options to those affected by conflict and crises in a region that has limited formal disaster management and social protection systems. Second, by mitigating shortcomings and distortions in regional labour markets. Third, by providing support to struggling rural economies and ever expanding urban areas in terms of livelihoods and social capital transfers. Chapter One consists of a study of the country’s historical experience of migration and, in particular, analyses the changes in official attitudes throughout the twentieth century, indicating the roots of contemporary ideas and policy dilemmas. Chapters Two, Three, Four and Five complement this analysis of the South African State’s capacity to reform and manage the South African migration situation by looking at often neglected dimensions: the first explores the question of skilled labour, a crucial question given the unbalanced structure of the South African labour market; the second examines the impact of migration on local government in South African cities and specifically implications for urban planning, service delivery, health, security, and political accountability; the third analyses the nature of undocumented migration to South Africa and the challenges it raises to both State and non-State actors; The book concludes with an examination of health as a critical issue when examining the relationship between migration and development in South Africa, in light of recent empirical data.

Today, the concept of "the refugee" as distinct from other migrants looms large. Immigration laws have developed to reinforce a conceptual dichotomy between those viewed as voluntary, often economically motivated, migrants who can be legitimately excluded by potential host states, and those viewed as forced, often politically motivated, refugees who should be let in. In Crossing, Rebecca Hamlin argues against advocacy positions that cling to this distinction. Everything we know about people who decide to move suggests that border crossing is far more complicated than any binary, or even a continuum, can encompass. The decision to leave home is almost always multi-causal and often involves many stops and hazards along the way--a reality not captured by a system that categorizes a majority of border-crossers as undeserving, and the rare few as vulnerable and needy. Drawing on cases of various "border crises" across Europe, North America, South America, and the Middle East, Hamlin outlines major inconsistencies and faulty assumptions upon which the binary relies, and explains its endurance and appeal by tracing its origins to the birth of the modern state and the rise of colonial empire. The migrant/refugee binary is not just an innocuous shorthand, indeed its power stems from the way in which is it painted as objective, neutral, and apolitical. In truth, the binary is a dangerous legal fiction, politically constructed with the ultimate goal of making harsh border control measures more ethically palatable to the public. This book is a challenge to all those invested in the rights and study of migrants, to interrogate their own assumptions and move towards more equitable advocacy for all border crossers.

The paper also highlights the crucial role of external partners, including the IMF, in helping MENA countries tackle these challenges.

Book excerpt: To understand the policy environment within which refugees establish and operate their enterprises in South Africas informal sector, this report brings together two streams of policy analysis. The first concerns the changing refugee policies and the erosion of the progressive approach that characterized the immediate post-apartheid period. The second concerns the informal sector policy, which oscillates between tolerance and attempted destruction at national and municipal levels. While there have been longstanding tensions between foreign and South African informal sector operators, an overtly anti-foreign migrant sentiment has increasingly been expressed in official policy and practice. This report describes the strategies being used to turn South Africa into an undesirable destination for refugees, including the setting up of additional procedural, administrative and logistical hurdles; the undercutting of court judgments affirming the right of asylum-seekers and refugees to employment and self-employment; ensuring that protection is always temporary by making it extremely difficult for refugees to progress to permanent residence and eventual citizenship; and restricting opportunities to pursue a livelihood in the informal sector. The authors conclude that the protection of refugee rights is likely to continue to depend on a cohort of non-governmental organizations prioritizing migrant livelihood rights and being willing and able to pursue time-consuming and costly litigation on their behalf.

Musoni sets these actions into a framework of illegality. He considers how countries have failed to secure their borders, why passports are denied to travelers, and how border jumping has become a phenomenon with a long history, especially in Africa. Musoni emphasizes cross-border travelers' active participation in the making of this history and how clandestine mobility has presented opportunity and creative possibilities for those who are willing to take the risk.
