This book introduces to an English-language audience another approach: principled labor law, based on Latin American perspectives, using a jurisprudential method focused on worker protection. The authors apply this methodology to the least likely case of labor-protective jurisprudence in the industrialized world: the United States. In doing so, Gamonal and Rosado focus on the Thirteenth Amendment as a labor-protective constitutional provision, the National Labor Relations Act, and the Fair Labor Standards Act. This book shows how principled labor law can provide a clear and simple method for consistent, labor-protective jurisprudence in the United States and beyond.

The authors explain how the tactics employed by the Bolsonaro administration to dismantle bureaucracy and public policies, especially labour and social policies, find expression in the fiscal austerity measures recently inscribed in the Federal Constitution: a counter-democratic device employed by technical and financial elites to systemically derail the social protection system. Through this in-depth case study, the book presents new theoretical arguments and concepts that can be useful to understand the dynamics of such new regimes, and discussing similar cases in other contexts. Democratic governments in Brazil, driven by social movements and political actors, have strengthened social protection through a distinctive institutional architecture that combines the strengthening of public bureaucracies, the creation of intergovernmental networks, and the democratic instances of social participation and agreement. The contributions throughout this volume analyze these transformations in different sectors of public policy, such as labour, employment, pensions, food and nutrition security, health, and social assistance. Each contribution discusses the recent trajectory through a political analysis of the main actors and institutions, reform processes and policy changes, and the results achieved. Finally, the existing weaknesses in each of these social protection sectors are identified in the context of the literature on policy dismantling, revealing the strategies used to take advantage of these political and institutional weaknesses. The main focus of Workers Before the Tribunal is to overcome traditional binary oppositions between corporativist and contratualist models of labor relations, the former representing a view in which the working class would have more autonomy in struggling for better labor conditions, the latter meaning the protagonism of the State in promoting labor rights. Teixeira da Silva presents three main arguments. First, he shows that the Brazilian labor justice system created during the Getúlio Vargas dictatorship (1930-1945), although inspired by Mussolini's legal order in Italy, is very different from the Fascist Magistratura del Lavoro. Second, in his comparative analysis with other national cases, such as the United States, France, Germany and Australia, the author argues that there was a large circulation of ideas and practices, resulting in a more complex dynamic of appropriation of international ideas on labor rights and institutions in Brazil. Third, Teixeira da Silva demonstrates that litigation in labor courts was one strategy of the working-class movement in Brazil, together with strikes and other means of confrontation. Therefore, he questions historiographical and political approaches that see labor justice as a weak substitute for class action. The "jurisdictionalization" of labor relations became a constitutive element in the making of the Brazilian working class. The book is anchored in the research of hundreds of labor litigation cases during the dramatic months preceding the 1964 civil-military coup d’état that inaugurated a quarter century of dictatorial rule in Brazil.
