Download or read book Red Tape written by Robin Ellison and published by Cambridge University Press. This book was released on 2018-06-14 with total page 717 pages. Available in PDF, EPUB and Kindle. Book excerpt: Red Tape tells the sometimes astonishing story of the making of laws, both good and bad, the recent explosion in rule making, and the failure of repeated attempts to rationalise the statute books - even governments themselves are concerned about the increasing number and complexity of our laws. Society requires the rule of law, but the rule of too much law means that the general public faces frustrating excesses created by overzealous regulators and lawmakers. Robin Ellison reveals the failure of repeated attempts to limit the number and complexity of new laws, and the expansion of regulators. He challenges the legislature to introduce fewer yet better laws and regulators by encouraging lawmakers to adopt practices which improve the efficiency of the law and the lives of everyone. Too much law leads to frustration for all - Red Tape is a long overdue exposé of our legal system for practitioners and consumers alike.

Download or read book The Enterprising Barrister written by Atalanta Goulandris and published by Bloomsbury Publishing. This book was released on 2020-06-11 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: What is it like working as a barrister in the 21st century? The independent Bar has transformed in the last 30 years into a commercialised, enterprising profession. Based on interviews with and observation of barristers and chambers' staff, this book identifies key changes that have taken place at the Bar and how these are reshaping and reformulating barristers' professionalism and working culture. This is the first empirical overview of the depth, scope and effects of multiple reforms that have been imposed on the profession. It explores how this once unified profession has fragmented, as the lived experiences of barristers in different practice areas have diverged. Highly specialised sets of chambers now operate like businesses, whilst others, who are dependent on legal aid funding, struggle to survive. This book offers a unique examination of different sites of change: how the chambers model has evolved, how entrepreneurial barristers market themselves, how aspirant law students prepare to enter the profession and how regulatory and procedural reforms have imposed managerial constraints on practitioners. The conclusion considers what the far-reaching changes mean for the prospects of the Bar in England and Wales.

Book Courtroom to Revolutionary Stage

Download or read book Courtroom to Revolutionary Stage written by Henning Grunwald and published by Oxford University Press. This book was released on 2012-09-27 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: What role did the courts play in the demise of Germany's first democracy and Hitler's rise to power? Courtroom to Revolutionary Stage challenges the orthodox interpretation of Weimar political justice. Henning Grunwald argues that an exclusive focus on reactionary judges and a preoccupation with number-crunching verdicts has obscured precisely that aspect of trials most fascinating to contemporary observers: their drama. Drawing on untapped sources and material previously inaccessible in English, Grunwald shows how an innovative group of party lawyers transformed dry legal proceedings into spectacular ideological clashes. Supported by powerful party legal offices (which have hitherto escaped scholarly notice almost entirely), they developed a sophisticated repertoire of techniques at the intersection of criminal law, politics, and public relations. Harnessing the emotional appeal of tens of thousands of trials, Communists and (emulating them) National Socialists institutionalized party legal aid in order to build their ideological communities. Defendants turned into martyrs, trials into performances of ideological self-sacrifice, and the courtroom into 'revolutionary stage', as one prominent party lawyer put it. It is this political justice as 'revolutionary stage' that most powerfully impacted Weimar political culture. While it helps to explain Weimar's demise, this argument about the theatricality of justice transcends interwar Germany. Trials were compelling not because they offered instruction about the revolutionary struggle, but because in a sense they were the revolutionary struggle. The ideological struggle, their message ran, left no room for fairness, no possibility of a 'neutral platform': justice was unattainable until the Republic was destroyed.
