The two most common structures are the mayor-council form and the council-manager form. In many large U.S. cities, there have been passionate movements to change the structure of city governments and equally intense efforts to defend an existing structure. Charter change (or preservation) is supported to solve problems such as legislative gridlock, corruption, weak executive leadership, short-range policies, or ineffective delivery of services. Some of these cities changed their form of government through referendum while other cities chose to retain the form in use. More than Mayor or Manager offers in-depth case studies of fourteen large U.S. cities that have considered changing their form of government over the past two decades: St. Petersburg, Florida; Spokane, Washington; Hartford, Connecticut; Richmond, Virginia; San Diego, California; Oakland, California; Kansas City, Missouri; Grand Rapids, Michigan; Dallas, Texas; Cincinnati, Ohio; El Paso, Texas; Topeka, Kansas; St. Louis, Missouri; and Portland, Oregon. The case studies shed light on what these constitutional contests teach us about different forms of government—the causes that support movements for change, what the advocates of change promised, what is at stake for the nature of elected and professional leadership and the relationship between leaders, and why some referendums succeeded while others failed. Book excerpt: Good Administration and the Council of Europe: Law, Principles, and Effectiveness examines the existence and effectiveness of written and unwritten standards of good administration developed within the framework of the Council of Europe (CoE) and in the case law of the European Court of Human Rights. These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.

Book excerpt: The nexus between best practices and student achievement is demonstrated from the GRASP Project, discovering how some California charter schools with higher academic achievement showed evidence of a greater number of best practices as measured by performance, governance, education program, human resources, business practices, and facilitiesthe education program infrastructure. Surprisingly, technology did not show a correlation for reasons explained in the nexus. Moreover, the nexus is bolstered by administrative, innovation, and competition theory serving as foundations for The Nexus. The Nexus also introduces strategies to implement best practices and process improvements through Lean Six Sigma methods and strategic and action planning. The search for the next practice designed to improve education programs is perpetual. The significance to accreditation is profound as student achievement measures will require metrics paced to reform movements such as Common Core Standards derived from international settings. By the same token, quality education will become clearer as edification through international benchmarks such as ISO 9000 will promote higher standards of excellence. The Nexus conclusions have relevance to all school systems since implementing best practices can elevate student achievement. The reason is clear: the more a school system operates efficiently through best practices and process improvements, the more time is available to the school leadership to devote attention to academic achievement as the ultimate product of education. And for those invested in school improvement, a higher value-added education with a higher return on investment.
