Book excerpt: First published in 1999, Making Foreign People Pay deals with the recovery of monetary claims in cross-border legal relations and contains the results of a comparative empirical research of debt recovery procedures of three countries with different socio-legal environments, Germany, England and Turkey. In order to analyse judicial debt recovery of cross-border claims, court statistics and files have been evaluated. The data show an infrequent use of the courts in all three countries. It seems that legal efforts aiming at facilitating international procedures have not been successful. But court procedures for the recovery of monetary claims are now to a large extent interchangeable with what may be called ‘privatised methods of debt collection’, including modern financial services such as factoring, forfaiting and commercial debt collection. Empirical evidence shows that such privatization of debt collection is a strong trend in cross-border debt collection. The book is an empirical contribution to the ongoing discussion of globalization processes and describes an important field of the globalization of law.

In traditional societies, relationships and identities were strongly vertical: there was a clear line of authority from top to bottom, and identity was fixed by one's birth or social position. But in modern society, identity and authority have become much more horizontal: people feel freer to choose who they are and to form relationships on a plane of equality. The author examines how modern life centers on human identity seen in terms of race, gender, ethnicity, and religion, and how this new way of defining oneself affects politics, social structure, and the law. He claims that our horizontal society is the product of the mass media -- in particular, television -- which break down the isolation of traditional life and allow individuals to connect with like-minded others across barriers of space and time. As horizontal groups blossom, loyalties and allegiances to smaller groups fragment what seemed to be the unity of the larger nation. In addition, the media's ability to spread a global mass culture causes a breakdown of cultural isolation that leads to more immigration and heavy pressure on the laws and institutions of citizenship and immigration.

Their coauthored 1971 book Theory of Society or Social Technology laid out their opposing positions on meaning, communication, consensus, and dissent—and ultimately the foundations of modern social thought. Habermas and Luhmann would elaborate their disagreement in the years to come in a controversy whose aftershocks divided social theorists by presenting what appeared to be two fundamentally divergent views of the nature of society and what systems theory was capable of explaining. This is the first book in English about one of the most important conflicts in social theory today. Gorm Harste analyzes the Habermas-Luhmann debate from its inception through Habermas’s most recent works, exploring issues such as methodology, ideology, truth, history, and politics. He contextualizes their positions in terms of how each grappled with the legacy of Nazism and sought to provide grounding for an antitotalitarian politics.
