National Energy Board and published by . This book was released on 2007 with total page 64 pages. Available in PDF, EPUB and Kindle. Book excerpt: TransCanada PipeLines Limited (TransCanada) owns and operates the Mainline natural gas transmission system, which extends from the Alberta border across Saskatchewan, Manitoba, Ontario, through a portion of Québec and connects to various downstream Canadian and international pipelines. In an application dated 5 December 2006, as amended on 13 February 2007, TransCanada applied to the National Energy Board (Board or NEB) under Part IV of the National Energy Board Act (Act) for an order approving a new receipt point at Gros Cacouna in the province of Quebec for the receipt of natural gas from a liquefied natural gas (LNG) regasification terminal. TransCanada also sought affirmation that the new receipt point would be served as an integrated part of TransCanada's Mainline, and that the tolls for services from the new receipt point would be calculated with the same rolled-in methodology used to calculate tolls for services from other receipt points east of the Saskatchewan Zone. In this document, the Board presents its reasons for decision with respect to TransCanada's Gros Cacouna receipt point application heard by the Board in the RH-1-2007 proceeding.--Includes text from document.

Book excerpt: In early 2008, the National Energy Board (Board or NEB) identified a proposed approach for the Land Matters Consultative Initiative (LMCI), consisting of four distinct topic streams. One of the streams, Stream 3, was Pipeline Abandonment--Financial Issues. The Board indicated that the key issue to be considered in respect of that stream was: "What is the optimal way to ensure that funds are available when abandonment costs are incurred?" The Board noted two key principles fundamental to its future decisions with respect to the financial matters related to pipeline abandonment. These were: a) Abandonment costs are a legitimate cost of providing service and are recoverable upon Board approval from users of the system; and b) Landowners will not be liable for costs of pipeline abandonment. These Reasons for Decision provide an overview of the matters considered by the Board in reaching a decision in respect of the abandonment cost estimates applications.--Document.

Book Aboriginal Consultation Environmental Assessment and Regulatory Review in Canada

Download or read book Aboriginal Consultation Environmental Assessment and Regulatory Review in Canada written by Kirk N. Lambrecht and published by University of Regina Press. This book was released on 2013 with total page 209 pages. Available in PDF, EPUB and Kindle. Book excerpt: Supreme Court of Canada decisions have defined a general framework for the "duty to consult" Aboriginal peoples and accommodate their concerns over natural resource development, but anticipate the details of that framework will be expanded upon in the future. Aboriginal Consultation, Environmental Assessment, and Regulatory Review in Canada offers a paradigm that advances that discussion. It proposes an integrated and robust planning model for natural resource extraction allowing Aboriginal peoples, industry, governments, tribunals, and the Courts to all make contributions to reconciliation in the context of sustainable development and environmental protection. Kirk Lambrecht surveys the law of actual and asserted Aboriginal rights and historical and modern Treaty rights in Canada and discusses the national and international purposes of environmental assessment and regulatory review. He appraises the fundamental principles of Supreme Court of Canada jurisprudence defining aboriginal consultation and accommodation as a constitutional imperative and uses case studies involving the National Energy Board to demonstrate how integrated process has evolved over time. Finally he offers general conclusions on the practical utility, and outstanding challenges, involving an integrated planning paradigm.

She transformed a truck driver who had done little reading into someone who finished his bachelors, masters, and has now completed a doctoral degree! What I do know is that her kind spirit and gentle encouragement spurred me onwards toward a thirst for reading and learning all I can. The simple reality is this: the work Dr. Mary Nance has done works! I am living proof! Dr. Ashley Olinger, Senior Pastor, First Baptist Church, Williston, North Dakota

Book Managing Belt and Road Business Disputes

Download or read book Managing Belt and Road Business Disputes written by Michael Moser and published by Kluwer Law International B.V.. This book was released on 2021-04-07 with total page 460 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a follow-up to the comprehensive Managing Business Disputes in Today’s China: Duelling with Dragons (2007) guide on foreign direct investment disputes that can arise in the course of initiating and operating a Chinese joint venture. Since its inauguration by the Chinese government in 2013, the ‘Belt and Road Initiative’ (BRI) has included projects in more than 70 countries spanning diverse economic and legal environments. The nature of the BRI coupled with the economic downturn as a result of the COVID-19 pandemic will inevitably generate more challenges than ever. Like its predecessor, this book poses a hypothetical scenario in order to explore the potential issues that may arise from Chinese-foreign business relationships in the BRI context. After setting the scene with the ‘Afrina Government’s’ ill-fated infrastructure project involving Chinese and foreign parties, subsequent chapters provide comprehensive insight on and highlight the following issues that one must consider when dealing with BRI disputes: dispute settlement options; informal dispute settlement approaches; disputes involving Chinese State-Owned Enterprises; construction and project finance disputes; corruption and bribery; sanctions; environmental issues. This book will provide extensive guidance from seasoned practitioners on the legal and practical issues of disputes that arise from engaging with Chinese companies doing business outside China in the context of BRI projects.
