As well as reflecting the diversity of legisprudence as a re-emerging academic field, it offers a broad overview of current developments and challenges in the theory of legislation, and aspires, moreover, to counterbalance some questionable ideas or misconceptions, widespread among jurists, on what making laws entails. The book is organized into three parts. The first comprises a sample of ‘ways and models of legislation’, ranging from classic legislative ideals to contemporary forms of regulation. The essays in this part, variances of focus notwithstanding, revolve around the notions of legislative rationality, quality, effectiveness, and legitimacy, which may be regarded as the cornerstones of legisprudence. Interwoven with these notions is another core legisprudential concern: the justification of laws. We address it separately in the next part by exploring the connection between lawmaking, argumentation and constitutional democracy: under the heading ‘legislation in a culture of justification’, a number of aspects of this connection are tackled that have not been sufficiently considered so far in legisprudential literature, such as the intricacies of legislative reasoning and balancing, or the justificatory problems posed by special-interest legislation. The under privileged status of legisprudence in legal studies and the need for socially attentive and citizen-oriented legislative research come to the fore in the third part of the book which turns to the relationships between ‘legisprudence, lawyers, and citizens’. All in all, the thirteen articles gathered here provide a stimulating insight into the theory of legislation, and can hopefully contribute to the reconciliation of the study of law and the study of its making.

If it was axiomatic that the goal of human society should be the common good, then this notion presented at least two conceptual alternatives. Did it embody the highest moral ideals of happiness and the life of virtue, or did it represent the more pragmatic benefits of peace and material security? Political thinkers from Thomas Aquinas to William of Ockham answered thisquestion in various contexts. In theoretical terms, they were reacting to the rediscovery of Aristotle's Politics and Ethics, an event often seen as pivotal in the history of political thought. On a practical level, they were faced with pressing concerns over the exercise of both temporal and ecclesiastical authority - resistance to royal taxation and opposition to the jurisdiction of the pope. In establishing the connections between these different contexts, The Common Good questions the identification of Aristotle as the primary catalyst for the emergence of 'the individual' and a 'secular' theory of the state. Through a detailed exposition of scholastic political theology, it argues that the roots of any such developments should be traced, instead, to Augustine and the Bible.

Con la finalidad de introducir en el debate penal la necesidad de evaluar las políticas penales, el Grupo Español de Política Legislativa Penal se embarcó en una investigación conjunta. El resultado es este libro que pretende abordar al menos un aspecto de cada uno de los ejes de la evaluación: desde análisis teórico-prácticos acerca de cómo se debe evaluar, pasando por experiencias singulares en algunos países, hasta llegar al control constitucional de las leyes penales. Todo ello sin olvidar la importancia de las estadísticas para poder realizar evaluaciones de calidad y el que quizá sea uno de los temas más novedosos: la utilización de análisis de costes, coste-eficacia y coste-beneficios en la evaluación de las políticas criminales, así como la contribución de los estudios económicos en la configuración de principios como el de lesividad. Pese al intento de acercarse a los diversos perfiles y consecuencias que la evaluación implica para la política criminal, esta publicación constituye únicamente un punto de partida que habrá alcanzado en buena medida sus objetivos si consigue poner en la agenda pública la evaluación de las normas penales.
