Book excerpt: In "Le strutture del diritto penale", Antonio Fiorella affronta lo studio della norma e della fattispecie penale nella loro analisi statica e dinamica, cercando di dar pieno conto di un diritto penale visto non quale semplice complesso di ‘prescrizioni’ cui seguano immancabili sanzioni, né quale ‘comando’ dinanzi al quale non resti al destinatario che di chinare il capo e obbedire, ma quale ‘orientamento’ verso un complesso di precetti e valori da rispettare.Dal punto di vista tecnico l’intento dell’opera Le strutture del diritto penale è quello di dare maturo risalto alle ‘relazioni strutturali’ formali e sostanziali tra norme e fattispecie; relazioni che modificano e precisano la ‘fisionomia’ della singola norma e della fattispecie prese in sé e per sé (concezione strutturale del diritto penale). Tutto ciò attraversando i luoghi del reato e delle sue forme di manifestazione, dei fenomeni che attengono più peculiarmente alla ‘punibilità’ e alla pena, oppure ad altre conseguenze sanzionatorie, per finire con la trattazione dell’illecito dell’ente da reato. Tenendo conto che punto di osservazione essenziale, nell’analisi della materia, è il processo e l’esecuzione penale, che consente di stabilire il significato delle norme ‘per come vengono praticate’, il metodo è dunque quello dell’analisi strutturale della norma e della fattispecie per come vivono. Non dimenticando che il ‘modo in cui vivono’ può rivelarsi in irrimediabile contrasto con la legge positiva, la cui corretta applicazione va comunque assicurata nel rispetto del principio di stretta legalità; non dimenticando che l’analisi strutturale si riferisce anche alle relazioni tra le componenti sostanziali del contenuto complessivo di gravità del reato, in una proiezione teleologico-valutativa dell’interpretazione.
