The conceptual criticisms presented in this book focus on the descriptive and normative misconceptions about property and contracts that are deeply embedded ideology in neoclassical economics, not to mention in the broader society. The book recognizes that the idealized microeconomic theory is not descriptive of reality and focuses its criticism on conceptual mistakes in the theory, which are even clearer due to the idealized nature of the theory. Therefore, the book is a must-read for scholars, researchers, and students interested in a better understanding of jurisprudence in economics, neoclassical microeconomic theory, and political economy in general.

In this authoritative intellectual history, James R. Hackney Jr. situates the modern law and economics movement within the trajectory of American jurisprudence from the early days of the Republic to the present. Hackney is particularly interested in the claims of objectivity or empiricism asserted by proponents of law and economics. He argues that the incorporation of economic analysis into legal decision making is not an inherently objective enterprise. Rather, law and economics often cloaks ideological determinations—particularly regarding the distribution of wealth—under the cover of science. Hackney demonstrates how legal-economic thought has been affected by the prevailing philosophical ideas about objectivity, which have in turn evolved in response to groundbreaking scientific discoveries. Thus Hackney’s narrative is a history not only of law and economics but also of select strands of philosophy and science. Within that institutional structure, the individuals who comprise that society attempt to cooperate with one another to their mutual advantage so as to accommodate their joint utility-maximizing endeavors. In addition, these same individuals call upon certain societal institutions to adjust the con flicting claims of different individuals and groups. In this regard, a society is perceived as both a cooperative venture for mutual advantage where there are an identity of interests and, as well, an arena of conflict where there exists a mutual interdependence of conflicting claims or interests. The manner in which a society structures its political-legal-economic institutions 1) to enhance the scope of its cooperative endeavors and 2) to channel internal political-legal-economic conflicts toward resolution, shapes the character of economic life in that society. In contemplating the structure of its institutions intended to promote cooperation and channel conflict, a society confronts several issues. At the most general level an enduring issue is how a society both perceives and then ideologically transmits (perhaps teaches or rationalizes), inter nally and/or externally, its perceptions of so-called "cooperative en deavors" and "arenas of conflict." There can be no doubt that the resultant structure of a society's institutions will reflect that society's perception as to what cooperation entails and what conflict constitutes.

Book excerpt: This monograph offers a new foundation for information theory that is based on the notion of information-as-distinctions, being directly measured by logical entropy, and on the re-quantification as Shannon entropy, which is the fundamental concept for the theory of coding and communications. Information is based on distinctions, differences, distinguishability, and diversity. Information sets are defined that express the distinctions made by a partition, e.g., the inverse-image of a random variable so they represent the pre-probability notion of information. Then logical entropy is a probability measure on the information sets, the probability that on two independent trials, a distinction or “dit” of the partition will be obtained. The formula for logical entropy is a new derivation of an old formula that goes back to the early twentieth century and has been re-derived many times in different contexts. As a probability measure, all the compound notions of joint, conditional, and mutual logical entropy are immediate. The Shannon entropy (which is not defined as a measure in the sense of measure theory) and its compound notions are then derived from a non-linear dit-to-bit transform that re-quantifies the distinctions of a random variable in terms of bits—so the Shannon entropy is the average number of binary distinctions or bits necessary to make all the distinctions of the random variable. And, using a linearization method, all the set concepts in this logical information theory naturally extend to vector spaces in general—and to Hilbert spaces in particular—for quantum logical information theory which provides the natural measure of the distinctions made in quantum measurement. Relatively short but dense in content, this work can be a reference to researchers and graduate students doing investigations in information theory, maximum entropy methods in physics, engineering, and statistics, and to all those with a special interest in a new approach to quantum information theory.

Intangible Flow Theory in Economics: Human Participation in Economic and Societal Production outlines a new theory that challenges both economics and the relativism conveyed in social constructivism, poststructuralism and postmodernism. To mainstream economics and Marxism, monetary flows transform us humans into commodities. To this new theory, flows of economic elements as physical goods or money are consummated by intangible flows that cannot yet be precisely appraised at an actual or approximate value, for instance, workflows, service flows, information flows or communicational flows. The theory suggests a systematic alternative to refute the human commodity framework and interrelated conjectures (e.g. human capital, human resources, human assets). Furthermore, it exhibits that economic and societal production is fully integrated on the biosphere. Conversely, contemporary relativism argues for the end of theory development, suspension of evidence and entrenchment of knowledge validity among local systems (named as paradigms, epistemes, research programs, truth regimes or other terms). Thus, relativism tacitly supports dominant theories as the human commodity framework because it preventively sabotages the creation of new theoretical explanations. Disputing relativist theses, intangible flow theory demonstrates that innovative theoretical explanations remain possible. This book is of significant interest to students and scholars of political economy, economic sociology, organization, economics and social theory.
