A second line of inquiry looks for ways to encourage innovative suppliers. Expanding on research in the editors’ prior volume, Integrity and Efficiency in Sustainable Public Contracts: Balancing Corruption Concerns in Public Procurement Internationally (Bruylant 2014), this volume builds on a series of academic conferences and exchanges to address these issues from sophisticated academic, institutional and practical perspectives, and to point the way to future research on the contractual models that are emerging from new procurement technologies.

The significance of liberalised and integrated Public Private Partnership Contracts as an essential component of the world legal and policy order is well documented. The regulation of PPPs is justified economically to allow for competition in the relevant public service and to achieve price transparency, thus resulting in significant savings for the public sector. In parallel to the economic justifications, legal imperatives have also called for the regulation of PPPs in order to allow free movement of goods and services and to prohibit discrimination on grounds of nationality. The need for competitiveness and transparency in delivering public services through PPPs is considered a safeguard to achieve international standards in delivering public utility services. First, it assesses the compatibility of the current PPPs legislation and regulation in the MENA region with the international standards of legislation and regulation prevalent in many other countries, including the UK, France and Brazil. Secondly, it compares the practices in the MENA region with those of international bodies such as the OECD and World Bank. Comparisons are then made between the MENA countries and those in Europe and Asia with regard to the influence of culture, policy and legal globalization. In the past few years, public technology procurement has been a relatively neglected topic in the theoretical and research literature on the economics of innovation. Similarly, preoccupation with `supply-side' measures has led policy-makers to avoid making very extensive use of this important `demand-side' instrument. These trends have been especially pronounced in the European Union. There, as this book will argue, existing legislation governing public procurement presents obstacles to the use of public technology procurement as a means of stimulating and supporting technological innovation. Recently, however, there has been a gradual re-awakening of practical interest in such measures among policy-makers in the EU and elsewhere. For these and other related measures, this volume aims to contribute to a serious reconsideration of public technology procurement from the complementary standpoints of innovation theory and innovation policy.

They are intermediated by counterparties in different jurisdictions which rely on costly trusted relationships to offset the lack of a common settlement asset as well as common rules and governance. In this paper, we present a vision for a multilateral platform that could improve cross-border payments, as well as related foreign exchange transactions, risk sharing, and more generally, financial contracting. The approach is to leverage technological innovations for public policy objectives. A common ledger, smart contracts, and encryption offer significant gains to market efficiency, completeness, and access, as well as to transparency, transaction and compliance costs, and safety. This paper is a first step aiming to stimulate further work in this space.

Book excerpt: The Directive 2014/24/EU on Public Procurement (“the Directive 2014/24), the Directive 2014/25/EU on Utilities, and the European Commission have as one of their aims the impulse of aggregation of public purchases by means of central purchasing bodies and other aggregated procurement techniques. The interest and initiative of public procurement stakeholders, particularly the Commission, some Member States, and some contracting authorities to strengthen and develop further centralized purchasing techniques. As part of these efforts, centralized purchasing services are now seen not only as purely national option but rather as a vehicle for public-public cross-border collaboration. For the first time in EU/EEA public procurement history, the Public Procurement Directives expressly contemplate the possibility of awarding public contracts through contracting authorities from different MS by means of cross-border procurement collaboration. These cross-border collaborative provisions allegedly allow contracting authorities “derive maximum benefit from the potential of the internal market in terms of economies of scale and risk-benefit sharing” and minimize risks. Cross-border centralization collaboration opens the door to a novel and innovative way of carrying out public procurement that steers away from a purely public and national procurement purchasing option regarding which entity 'buys for you' to a 'buy-through Europe' model, towards the maximum optimization or public resources. Based on this, contracting authorities can enter into public contracts for the purchasing of works, goods or services through a CPB located in a different MS and under the scope of two or more legal regimes. While a well-intended idea, it is not clear, however, whether these cross-border CPB provisions will be workable in practice due to the complexity of its implementation and the legal and economic obstacles they will face.
