Download or read book Protection of Traditional Cultural Expressions in Latin America written by Anna Friederike Busch and published by Springer. This book was released on 2015-05-19 with total page 476 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the topic of protecting traditional cultural expressions (TCEs) in Latin America. It questions classic legal approaches and involves the interface of anthropology and law. The study analyses regional, national and local particularities of law on paper and law in reality. It includes personal fieldwork research in selected countries and puts light on the political, socio-economic and environmental dimension of the topic. Based upon these insights, the study gives recommendations for a more enhanced, interdisciplinary understanding and protection of TCEs. Latin America is (still) rich of cultural traditions and bio- and sociodiversity. This region is the cradle of the international discussion on protecting TCEs. The national situations are diverse and allow conclusive comparisons. Some countries have established concrete protection systems, like Panama, and made useful experiences. It is time to resume: What do TCEs really mean? Should they be protected by law and if so, how? What can we learn from the practical experiences made so far? The following is clear: The true test for any new legislation – in Latin America and elsewhere – is its impact on the everyday life.

Download or read book Knowledge Generation and Protection written by Jorge Mario Martínez-Piva and published by Springer Science & Business Media. This book was released on 2009-12-03 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the English version of the text published by the Economic Commission for Latin America and the Caribbean in April 2008 and entitled Generación y protección del conocimiento: propiedad intelectual, innovación y desarrollo 1 económico. Since then, the year that has passed has been fraught with uncertainty but has also brought signs of hope. Indeed, the past year was marked by the outbreak of the deepest and most p- vasive nancial and economic crisis since the Great Depression of 1929, a crisis generated in the United States but whose negative repercussions have spread at a phenomenal rate throughout the planet. The impact of this crisis on the p- ples of Latin America and the Caribbean will undermine the region’s prospects for economic growth, employment, and poverty alleviation. This was the year in which United States citizens elected Barack Obama as their President, a clear sign of new hope. This hope was tangible at the Fifth Summit of the Americas, held in 2009 in Port of Spain, which marked a turning point in the relations between the countries that make up this hemisphere. The open posture of the United States and that country’s readiness to listen rather than to impose any particular position and its willingness to engage in dialogue on an equal footing were positive signs. Moreover, it was generally admitted that there is not just one model for advancing successfully toward development.
Download or read book Intellectual Property Law and Human Rights written by Paul Torremans and published by Kluwer Law International B.V.. This book was released on 2020-06-08 with total page 1046 pages. Available in PDF, EPUB and Kindle. Book excerpt: Intellectual Property Law and Human Rights Fourth Edition Edited by Paul L.C. Torremans Once regarded as a niche topic, the nexus of intellectual property and human rights now lies in the eye of the storm that is today’s global economy. In this expanded new edition of the pre-eminent work in this crucial area of legal theory and practice – with nine completely new chapters – well-known authorities in both intellectual property law and human rights law present an in-depth analysis and discussion of essential and emerging issues in the convergence of intellectual property law and human rights law. The fourth edition is fully updated to address current matters as diverse as artificial intelligence, climate change, and biotechnological materials, all centred on the relations between intellectual property and freedom of expression and the fundamental right to privacy in an intellectual property environment. The contributors address such topics as the following and more: the status of copyright as a fundamental right; fair use, transformative use, and the US First Amendment; intellectual property in the jurisprudence of the European Court of Human Rights; freedom to receive and impart information under the EU Charter of Fundamental Rights; how to mitigate the risks article 17 of Directive 2019/970 poses to freedom of expression; fair dealing defences; algorithmic copyright enforcement and free speech; developing a right to privacy for corporations; expanding the role of morality and public policy in European patent law; and ethical and religious concerns over patenting biotechnological inventions. As human rights issues continue to arise in an intellectual property context, practitioners, academics, and policymakers in both fields will continue to recognize and use this well-established cornerstone work in the debate as a springboard to the future development of the ever more prominent interface of intellectual property and human rights.
