Book excerpt: El objeto del presente estudio es tratar la cuestión de si la protección de datos personales y la innovación son compatibles o no, partiendo del artículo de Warren y Brandeis titulado «The Right to Privacy», en el que claramente se trataba ya la cuestión de la necesidad de proteger a la persona frente a intromisiones indebidas o mal uso de los datos personales en el caso de nuevas invenciones (innovación) y de métodos de negocio (modelos de negocio). Se trata, por tanto, de poner de manifiesto que, aunque lo pudiera parecer, éste no es un debate nuevo, sino que lleva planteándose desde, al menos, hace más de un siglo y la necesidad de encontrar un equilibrio a la vista de toda la experiencia acumulada, especialmente entre los Estados Unidos y la Unión Europea, pero sin olvidar a otros países o regiones alrededor del mundo. La presente obra ha sido galardonada con el premio de Investigación de la Cátedra Google sobre Privacidad, Sociedad e Innovación de la Universidad CEU-San Pablo de Madrid en su segunda edición. Miguel Recio Gayo es Licenciado en Derecho por la Universidad Carlos III de Madrid, Máster en Protección de Datos, Transparencia y Acceso a la Información por la Universidad CEU-San Pablo de Madrid y Máster en Derecho de la Propiedad Intelectual por The George Washington University Law School (Estados Unidos). Actualmente prepara su tesis doctoral sobre la figura del delegado de protección de datos (Chief Privacy Officer o Data Protection Officer). Es abogado especializado en Derecho de las Tecnologías de la Información y las Comunicaciones así como autor de varias publicaciones. Book excerpt: El desarrollo tecnológico en el ámbito de las TIC de la última década hace necesaria una reflexión sobre la situación actual de los derechos humanos en este nuevo escenario en el que convergen factores de diversa índole que propician riesgos de gran calado sobre todo para los derechos relativos a la vida privada. La expansión de Internet, con la aparición y consolidación de nuevos servicios utilizados por millones de personas en todo el mundo, el desarrollo de las tecnologías que integran el Internet de las cosas y la «tecnología vestible», la proliferación de los sistemas de geolocalización, entre otros, han propiciado un aumento sin precedentes en la cantidad de información personal disponible en la red para múltiples usos. Esa información cobra un nuevo valor en la era del Big Data y presenta nuevos riesgos para los derechos de las personas; pero, además, la información personal se encuentra en la red disponible para ser rastreada a través de sistemas de vigilancia masiva. Asimismo, la evolución de Internet, especialmente con la aparición de la web 2.0, ha implicado un nuevo escenario para el ejercicio de las libertades de expresión e información y, como consecuencia del efecto multiplicador del daño que la red opera sobre los derechos de la personalidad, el impacto negativo sobre estos derechos será mayor. Estas cuestiones se abordan desde la jurisprudencia del Tribunal Europeo de Derechos Humanos y el Tribunal de Justicia de la Unión Europea, y de los tribunales españoles, prestando especial atención a la jurisprudencia del Tribunal Constitucional, del Tribunal Supremo y de la Audiencia Nacional. También se tratan aquellos aspectos más novedosos de la Propuesta de Reglamento del Parlamento Europeo y del Consejo relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos (Reglamento general de protección de datos). Ana Garriga Domínguez es Profesora Titular de Filosofía del Derecho de la Universidad de Vigo y, en la actualidad, Directora de la Escuela Superior de Ingeniería Informática de esa Universidad. Asimismo es Directora del Laboratorio “Sociedad de la Información y derechos humanos” de la Universidad de Vigo, Laboratorio Consolider-Ingenio 2010 “El tiempo de los derechos”. Tiene numerosas publicaciones sobre el impacto de las TIC en los derechos fundamentales, en especial sobre el derecho a la protección de los datos personales, en artículos publicados en revistas científicas, capítulos de libro y monografías, habiendo participado en más de 10 proyectos de investigación, en varios de ellos como investigadora principal.

It provides a cultural critique of computing technologies, by exploring the history of computing and examining issues related to writing, representing, archiving and searching. The book raises awareness of, and calls for, the digital humanities to address the challenges posed by the linguistic and cultural divides in computing, the clash between communication and control, and the biases inherent in networked technologies. A common problem with publications in the Digital Humanities is the dominance of the Anglo-American perspective. While seeking to take a broader view, the book attempts to show how cultural bias can become an obstacle to innovation both in the methodology and practice of the Digital Humanities.
