Book excerpt: Youth have always had higher unemployment rates – about twice or more than the average – as they are usually the last to be hired in an expansion and the first to be let go in a recession. In addition, young people engage in extensive job searching in their early years, and this can imply considerable job churning as both youth and employers look for a good match. This highlights the importance of facilitating the school-to-work transition and having early interventions to assist such youth before negative conditions set in. It also highlights the potential importance of determining those young people most “at risk” of long-term unemployment, and of targeting or streaming them into programmes that will yield the largest incremental net benefits given their characteristics. Unemployed youth without previous work experience often are not eligible for unemployment insurance benefits when they first enter the labour market. When they do receive job search assistance, they often face a bewildering array of programmes that are available to assist them, often with little guidance to help them select the programs that best meet their needs. Consequently, ensuring that today’s youth do not become a “lost generation” is an urgent matter. George Bernard Shaw once said that it is too bad that “youth is wasted on the young”, implying that youth do not realize the opportunities they have as youth and only see them as they get older. There is a danger, however, that many of today’s youth may be never have those opportunities and hence not even see them with hindsight. This book and others in the ADAPT Labour Studies Book-Series are intended to deal with these challenges, to make sure that youth is not wasted on the young.

Its policies—encouraging foreign investment, privatizing public sector companies and services, lowering trade barriers, reducing the size of the state, and embracing the market as a regulator of both the economy and society—produced an economic boom that some have hailed as a “miracle” to be emulated by other Latin American countries. But how have Chile’s millions of workers, whose hard labor and long hours have made the miracle possible, fared under this program? Through empirically grounded historical case studies, this volume examines the human underside of the Chilean economy over the past three decades, delineating the harsh inequities that persist in spite of growth, low inflation, and some decrease in poverty and unemployment. Implemented in the 1970s at the point of the bayonet and in the shadow of the torture chamber, the neoliberal policies of Augusto Pinochet’s dictatorship reversed many of the gains in wages, benefits, and working conditions that Chile’s workers had won during decades of struggle and triggered a severe economic crisis. Later refined and softened, Pinochet’s neoliberal model began, finally, to promote economic growth in the mid-1980s, and it was maintained by the center-left governments that followed the restoration of democracy in 1990. Yet, despite significant increases in worker productivity, real wages stagnated, the expected restoration of labor rights faltered, and gaps in income distribution continued to widen. To shed light on this history and these ongoing problems, the contributors look at industries long part of the Chilean economy—including textiles and copper—and industries that have expanded more recently—including fishing, forestry, and agriculture. They not only show how neoliberalism has affected Chile’s labor force in general but also how it has damaged the environment and imposed special burdens on women. Painting a sobering picture of the two Chiles—one increasingly rich, the other still mired in poverty—these essays suggest that the Chilean miracle may not be as miraculous as it seems. Contributors. Book excerpt: The sharing economy is just one of several possible expressions to designate the complex model of social and economic relationships based on the intensive use of digital technology. Constant permutations and combinations allow these relationships to be established through the intervention of a third party making traditional contractual positions flexible in such a way that today’s employee is tomorrow’s entrepreneur, or today’s consumer is tomorrow’s supplier of goods and services. The current legal framework is, in many respects, unable to accommodate such big changes and new legal regulations are required where adaptation of the existing ones proves to be inadequate. This book highlights where changes are needed and where adaptations are required, with a particular focus on the Portuguese, Spanish, Italian, British and Brazilian contexts. For that, four different approaches are undertaken, namely the meta-legal, macro-legal, micro-legal and transnational approaches. The study that results from these different approaches enables readers to acquire a general view on the current legal problems arising from the sharing economy, and was a direct result of a research project of the Centre for Legal and Economic Research, at the University of Porto, funded by Fundação para a Ciência e Tecnologia.

Book excerpt: As the dust settles on nearly three decades of economic reform in Latin America, one of the most fundamental economic policy areas has changed far less than expected: labor regulation. To date, Latin America's labor laws remain both rigidly protective and remarkably diverse. Continuity Despite Change develops a new theoretical framework for understanding labor laws and their change through time, beginning by conceptualizing labor laws as comprehensive systems or "regimes." In this context, Matthew Carnes demonstrates that the reform measures introduced in the 1980s and 1990s have only marginally modified the labor laws from decades earlier. To explain this continuity, he argues that labor law development is constrained by long-term economic conditions and labor market institutions. He points specifically to two key factors—the distribution of worker skill levels and the organizational capacity of workers. Carnes presents cross-national statistical evidence from the eighteen major Latin American economies to show that the theory holds for the decades from the 1980s to the 2000s, a period in which many countries grappled with proposed changes to their labor laws. He then offers theoretically grounded narratives to explain the different labor law configurations and reform paths of Chile, Peru, and Argentina. His findings push for a rethinking of the impact of globalization on labor regulation, as economic and political institutions governing labor have proven to be more resilient than earlier studies have suggested.

An extensive body of research – summed up and analysed expertly in the chapters of this very important book – reveals that the process of decentralisation has more often than not led to a situation where salaries and labour conditions are ever more frequently determined by direct negotiations between employer and employees, with the State becoming the sole guarantor of employee protection even as it encourages decreasing labour costs to ensure that companies remain competitive. The comparative approach offered in this book adds to this synthesis by providing examples of speci c recent developments in fourteen Member States and Turkey.
