Book excerpt: Los datos se han convertido en un nuevo activo intangible de gran valor para los organismos privados y públicos a partir de los cuales pueden mejorar u ofrecer nuevos productos, servicios y procesos. Es lo que se denomina la innovación basada en los datos. Este incremento de valor de los datos provoca que su protección se haya convertido en una cuestión fundamental. La labor del profesional del Derecho para asesorar a estos organismos en este sentido no es fácil. Dejando aparte la necesaria adopción de medidas tecnológicas de protección, el carácter digital de los datos implica que las figuras jurídicas más adaptadas para su protección jurídica sean los derechos de propiedad intelectual. Pero, ¿a qué figura en particular debe acudirse: secretos comerciales, derechos de autor, derecho sui generis sobre las bases de datos, soluciones contractuales, la normativa sobre competencia desleal? Además, no es sólo la protección lo que debe preocupar a estos organismos y a sus asesores jurídicos. La eficiencia de las técnicas de análisis de datos o el desarrollo de sistemas de inteligencia artificial depende, en gran medida del acceso a grandes cantidades de datos. En este sentido, el acceso a datos externos deviene primordial, especialmente en la Unión Europea, donde sus instituciones insisten en que, una de las razones por las que nuestras empresas están en desventaja respecto de sus competidores extranjeros, es la escasa disponibilidad de datos. Se necesitan, por lo tanto, medidas que fomenten el acceso a los datos, para crear lo que la Comisión Europea llama los espacios europeos comunes de datos. Estas medidas incluyen, por ejemplo, la obligación de publicar en abierto la información del sector público, la promoción de la ciencia abierta, o el establecimiento de una excepción de minería de textos y datos. La adopción de estas medidas va a conllevar, necesariamente, una flexibilización del sistema de propiedad intelectual europeo. No obstante, dicha flexibilización no puede ser de tal calado que se desincentive la inversión en la producción de información y contenidos. Para alcanzar una adecuada ponderación de los intereses en presencia, en esta obra se aboga por la adopción del principio “tan abiertos como sea posible, tan cerrados como sea necesario” como criterio general rector a la hora de configurar estas nuevas medidas.Aurelio Lopez-Tarruella Martínez es Profesor Titular de Derecho internacional privado en la Universidad de Alicante, director del grupo de investigación Global Innovation Law & Policy, GIP Law (UA), y director de la Cátedra iberoamericana de Cultura Digital y Propiedad Intelectual.
