Book excerpt: This joint venture between ICOMOS, the advisory body to UNESCO on cultural sites, and the International Astronomical Union is the second volume in an ongoing exploration of themes and issues relating to astronomical heritage in particular and to science and technology heritage in general. It examines a number of key questions relating to astronomical heritage sites and their potential recognition as World Heritage, attempting to identify what might constitute "outstanding universal value" in relation to astronomy. "Heritage Sites of Astronomy and Archaeoastronomy--Volume 2" represents the culmination of several years' work to address some of the most challenging issues raised in the first ICOMOS-IAU Thematic Study, published in 2010. These include the recognition and preservation of the value of dark skies at both cultural and natural sites and landscapes; balancing archaeoastronomical considerations in the context of broader archaeological and cultural values; the potential for serial nominations; and management issues such as preserving the integrity of astronomical sightlines through the landscape.Its case studies are developed in greater depth than those in volume 1, and generally structured as segments of draft nomination dossiers. They include seven-stone antas (prehistoric dolmens) in Portugal and Spain, the thirteen towers of Chankillo in Peru, the astronomical timing of irrigation in Oman, Pic du Midi de Bigorre Observatory in France, Baikonur Cosmodrome in Kazakhstan, and Aoraki-Mackenzie International Dark Sky Reserve in New Zealand. Such seasonal movements have formed an important aspect of many European farming systems for several thousand years, although they have declined markedly since the nineteenth century. Ethnographers and geographers have long been involved in recording transhumant practices, and in the last two decades archaeologists have started to add a new material dimension to the subject. This volume brings together recent advances in the study of European transhumance during historical times, from Sweden to Spain, Romania to Ireland, and beyond that even Newfoundland. While the focus is on the archaeology of seasonal sites used by shepherds and cowherds, the contributions exhibit a high degree of interdisciplinarity. Documentary, cartographic, ethnographic and palaeoecological evidence all play a part in the examination of seasonal movement and settlement in medieval and post-medieval landscapes. Notwithstanding the obvious diversity across Europe in terms of livestock, distances travelled and socio-economic context, an extended introduction to the volume shows that cross-cutting themes are now emerging, including mobility, gendered herding, collective land-use, the agency of non-elite people and competition for grazing and markets. The book will appeal not only to archaeologists, but to historians, geographers, ethnographers, palaeoecologists and anyone interested in rural lifeways across Europe.

Key to it is the value of separation of powers. When the relationship between courts and the legislature realizes this value, it makes a stronger claim to moral legitimacy. Kyritsis steers a path between the two extremes of the sceptics and the enthusiasts. Against sceptics who claim that constitutional review is an affront to democracy he argues that it is a morally legitimate institutional option for democratic societies because it can provide an effective check on the legislature. Although the latter represents the people and should thus be given the initiative in designing government policy, it carries serious risks, which institutional design must seek to avert. Against enthusiasts he maintains that fundamental rights protection is not the exclusive province of courts but the responsibility of both the judiciary and the legislature. Although courts may sometimes be given the power to scrutinize legislation and even strike it down, if it violates human rights, they must also respect the legislature's important contribution to their joint project. Occasionally, they may even have a duty to defer to morally sub-optimal decisions, as far as rights protection is concerned. This is as it should be. Legitimacy demands less than the ideal. In turn, citizens ought to accept discounts on perfect justice for the sake of achieving a reasonably just and effective political order overall.
