Book An Environmental Court in Action

Download or read book An Environmental Court in Action written by Elizabeth C Fisher and published by Bloomsbury Publishing. This book was released on 2022-07-28 with total page 357 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a critical assessment of the New South Wales Land and Environmental Court (NSWLEC). Effective adjudication has become a key consideration for environmental lawyers. One of the most important questions is whether environmental law frameworks need their own courts, with the conclusion being: yes they do. Here, a pioneer of such a court, the NSWLEC is forensically examined to see what it might teach other such courts. Showing a court 'in action' it suggests models that practitioners and policy makers might follow. It also speaks to the environmental law scholars, setting out a conceptual framework for studying such courts as legal institutions. This multi-faceted collection is invaluable to scholars and practitioners alike.

It also explores the various mechanisms that account for changes, exploring how and when changes occur and what changes mean to humans. Relevant for empirical and theoretical work, the handbook will be of great interest to researchers, academics, and postgraduate students across psychology, behavioral sciences, and social sciences.

Book Promises to Keep

Download or read book Promises to Keep written by National Council on Disability, Washington, DC. and published by DIANE Publishing. This book was released on 2000 with total page 538 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report is the third in a series of independent analyses by the National Council on Disability on federal enforcement of civil rights laws. This report looks at the Americans with Disabilities Act (ADA) enforcement activities from 1990 to 1999 of four key federal agencies: the Department of Justice, the Equal Employment Opportunity Commission (EEOC), the Department of Transportation, and the Federal Communications Commission. Findings indicate that while the Clinton Administration has consistently asserted its strong support for the civil rights of people with disabilities, the federal agencies charged with enforcement and policy development under ADA have been underfunded, overly cautious, reactive, and lacking any coherent and unifying national strategy. In addition, it is found that enforcement agencies have not consistently taken leadership roles in emergent issues. The following recommendations are made: (1) the Department of Justice should provide assertive leadership for ADA implementation and develop a strategic vision and plan for ADA enforcement across the federal government; and (2) the Departments of Justice and Transportation, the EEOC, and the Title II referral agencies should strengthen methods for the timely and effective enforcement of ADA. Appendices include a summary of the ADA. (CR)

In that book, Garvin argues that old culture, old ideas and the repression of the Church held Ireland's development in check through the 1940s and 1950s. Gary Murphy suggests that the Irish government and civil service leaders were in fact open to change and new ideas and this openness led them to adopt outward-looking policies.

Download or read book The Social Constitution written by Whitney K. Taylor and published by Cambridge University Press. This book was released on 2023-06-30 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: In The Social Constitution, Whitney Taylor examines the conditions under which new constitutional rights become meaningful and institutionalized. Taylor introduces the concept of 'embedding' constitutional law to clarify how particular visions of law come to take root both socially and legally. Constitutional embedding can occur through legal mobilization, as citizens understand the law in their own way and make legal claims - or choose not to - on the basis of that understanding, and as judges decide whether and how to respond to legal claims. These interactions ultimately construct the content and strength of the constitutional order. Taylor draws on more than a year of fieldwork across Colombia and multiple sources of data, including semi-structured interviews, original surveys, legal documents, and participation observation.
