Book The Scope and Structure of Civil Codes

Download or read book The Scope and Structure of Civil Codes written by Julio César Rivera and published by Springer Science & Business Media. This book was released on 2014-02-04 with total page 477 pages. Available in PDF, EPUB and Kindle. Book excerpt: This detailed analysis of the content and configuration of civil codes in diverse jurisdictions also examines their relationship with some branches of private law as: family law, commercial law, consumer law and private international law. It analyzes the codification, decodification and recodification processes illuminating the dialogue between current codes – and private law legislation in general – with Constitutions and International Conventions. The commentary elucidates the changing requirements of civil law as it shifted from an early protection of patrimony to a support for commercial and contractual law. It also explains the varying trajectories of civil law, which in some jurisdictions was merged with religious legal tenets in its codification of familial relations, while in others it was fused with commercial law or, indeed, codified from scratch as a discrete legal corpus. Elsewhere, the volume provides material on differing approaches to consumer law, where relevant legislation may be scattered across numerous statutes, and also on private international law, a topic of increasing relevance in a world where business corporations have interests in multiple jurisdictions (and often play one off against another). The volume features invited contributions from leading scholars in the field of private law brought together for an in depth analysis of the current regulatory attitude in this field of the law in jurisdictions with diverse legal systems and traditions. In current times we are witnessing the adoption of diverging regulatory solutions. Through the analysis of the past and present of private law regulation, the volume unveils the underlying trends and relevance of the codification method across the world.

Book Grassroots Constitutionalism

Download or read book Grassroots Constitutionalism written by Norman W. Provizer and published by . This book was released on 1988 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume reflects the spirit of the 200th anniversary of the drafting of the constitution, with an added twist. The authors look at the constitution and the constitutional system through the lenses of a particular community. The study emphasizes the two-way flow that exists between local situations and constitutional decision making at the national level. Along with studies examining the community impact of court rulings, other essays explore local events that have turned into constitutional issues for the nation, in particular The Herold School-prayer case, the Shreveport Rate case, the post-traumatic stress disorder case, and the Grosjean freedom of press decision. While Part III deals with such cases and policies, Part II looks at the judges who combine national and local perspectives and who serve the connectors in this two-way system. Part I and IV, in turn, provide a variety of articles that are aimed at fleshing out the constitutional connection along both specific and general lines. This framework could be applied, with value, to any number of the communities. In each case, this view from the grassroots offers the opportunity to develop fresh insights into old subjects and to provide a closer sense of community involvement with the constitutional system that the nation justly celebrates.

Book excerpt: In the years following the landmark United States Supreme Court decision on libel law in New York Times v. Sullivan, the court ruled on a number of additional cases that continued to shape the standards of protected speech. As part of this key series of judgments, the justices explored the contours of the Sullivan ruling and established the definition of “reckless disregard” as it pertains to “actual malice” in the case of St. Amant v. Thompson. While an array of scholarly and legal literature examines Sullivan and some subsequent cases, the St. Amant case—once called “the most important of the recent Supreme Court libel decisions”—has not received the attention it warrants. Eric P. Robinson’s Reckless Disregard corrects this omission with a thorough analysis of the case and its ramifications. The history of St. Amant v. Thompson begins with the contentious 1962 U.S. Senate primary election in Louisiana, between incumbent Russell Long and businessman Philemon “Phil” A. St. Amant. The initial lawsuit stemmed from a televised campaign address in which St. Amant attempted to demonstrate Long’s alleged connections with organized crime and corrupt union officials. Although St. Amant’s claims had no effect on the outcome of the election, a little-noticed statement he made during the address—that money had “passed hands” between Baton Rouge Teamsters leader Ed Partin and East Baton Rouge Parish deputy sheriff Herman A. Thompson—led to a defamation lawsuit that ultimately passed through the legal system to the Supreme Court. A decisive step in the journey toward the robust protections that American courts provide to comments about public officials, public figures, and matters of public interest, St. Amant v. Thompson serves as a significant development in modern American defamation law. Robinson’s study deftly examines the background of the legal proceedings as well as their social and political context. His analysis of how the Supreme Court ruled in this case reveals the justices’ internal deliberations, shedding new light on a judgment that forever changed American libel law.
