Book Progress on Point MGM V Grokster

Download or read book Progress on Point MGM V Grokster written by and published by . This book was released on with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: There have been editorials all around the country and right across the ideological spectrum praising the decision, lines like "the Court threaded the needle exactly right" and the praise came from the Washington Post and the Washington Times, the New York Times and the Wall Street Journal, the LA Times and the San Jose Mercury News , the Boston Globe, the Boston American Statesman, the Chicago Tri. [...] The only question I leave for the copyright legislative experts here - is there anything that needs to be done to make it easier for the content providers really to offer all of the music to everybody? That's a difficult question and I don't expect answers but it's something to think about because I think we will really drive the nail in the coffin of illegitimate downloads if we can put the servi. [...] I get into ethical discussions with students on this and a lot of them are willing to subscribe to the idea that content holders have a duty to put this stuff up on the internet and spare customers the cost and inconvenience of having to pay for the physical delivery, and that once that's done it's unethical and immoral for the customers to to steal it. [...] Broadcast Flag, I think, is a great example of something where the FCC made a ruling, the court struck down the jurisdiction of the FCC, and it has nothing to do with the fact that we scored a legislative victory early in the session on the narrow bill or on the Grokster case. [...] But I think that's all we're talking about and I think we're happy - it's hard for a lawyer to talk about happiness with a decision - but in terms of the value of the decision, I think, and again, I'm not speaking for the tech community, but I'm sort of guessing that many in the tech community were not comfortable with the allegations by the content industry against Grokster and Streamcast.

Book Point Made

  • Author : Ross Guberman
  • Publisher : Oxford University Press
  • Release : 2014-03-06

Download or read book Point Made written by Ross Guberman and published by Oxford University Press. This book was released on 2014-03-06 with total page 426 pages. Available in PDF, EPUB and Kindle. Book excerpt: With Point Made, legal writing expert, Ross Guberman, throws a life preserver to attorneys, who are under more pressure than ever to produce compelling prose. What is the strongest opening for a motion or brief? How to draft winning headings? How to tell a persuasive story when the record is dry and dense? The answers are "more science than art," says Guberman, who has analyzed stellar arguments by distinguished attorneys to develop step-by-step instructions for achieving the results you want. The author takes an empirical approach, drawing heavily on the writings of the nation's 50 most influential lawyers, including Barack Obama, John Roberts, Elena Kagan, Ted Olson, and David Boies. Their strategies, demystified and broken down into specific, learnable techniques, become a detailed writing guide full of practical models. In FCC v. Fox, for example, Kathleen Sullivan conjures the potentially dangerous, unintended consequences of finding for the other side (the "Why Should I Care?" technique). Arguing against allowing the FCC to continue fining broadcasters that let the "F-word" slip out, she highlights the chilling effect these fines have on America's radio and TV stations, "discouraging live programming altogether, with attendant loss to valuable and vibrant programming that has long been part of American culture." Each chapter of Point Made focuses on a typically tough challenge, providing a strategic roadmap and practical tips along with annotated examples of how prominent attorneys have resolved that challenge in varied trial and appellate briefs. Short examples and explanations with engaging titles--"Brass Tacks," "Talk to Yourself," "Russian Doll"--deliver weighty materials with a light tone, making the guidelines easy to remember and apply. In addition to all-new examples from the original 50 advocates, this Second Edition introduces eight new superstar lawyers from Solicitor General Don Verrilli, Deanne Maynard, Larry Robbins, and Lisa Blatt to Joshua Rosencranz, Texas Senator Ted Cruz, Judy Clarke, and Sri Srinvasan, now a D.C. Circuit Judge. Ross Guberman also provides provocative new examples from the Affordable Care Act wars, the same-sex marriage fight, and many other recent high-profile cases. Considerably more commentary on the examples is included, along with dozens of style and grammar tips interspersed throughout. Also, for those who seek to improve their advocacy skills and for those who simply need a step-by-step guide to making a good brief better, the book concludes with an all-new set of 50 writing challenges corresponding to the 50 techniques.

Book Research Handbook on the Future of EU Copyright

Download or read book Research Handbook on the Future of EU Copyright written by Estelle Derclaye and published by Edward Elgar Publishing. This book was released on 2009-01-01 with total page 667 pages. Available in PDF, EPUB and Kindle. Book excerpt: . . . an important contribution to the study of EU copyright law. It provides a good overview of different aspects of copyright law in the European Union and comprises a prevailing guide which undoubtedly will be of great use to both academics and practitioners. Ghufran Sukkaryeh, European Intellectual Property Review Estelle Derclaye s book is indeed a Handbook on EU copyright law, since practically every aspect of copyright law is examined through the lens of EU law by foremost European specialists. But it goes further than providing an understanding of what has been and ought to be happening in EU copyright law: each chapter can touch a raw nerve in the copyright law of any country in the world. Rarely has it been so obvious that EU copyright law can be considered a laboratory for copyright law in general. Ysolde Gendreau, Université de Montréal, Canada It has been over fifteen years since the EU started harmonising copyright law. This original Handbook takes stock and questions what the future of EU copyright should be. What went wrong with the harmonisation acquis? What did the directives do well? Should copyright be further harmonised? Each of the 25 recognised copyright experts from different European countries gives a critical account of the EU harmonisation carried out on several aspects of copyright law (subject-matter, originality, duration, rights, defences etc.), and asks whether further harmonisation is desirable or not. This way, the Handbook not only gives guidance to European institutions as to what remains to be done or needs to be remedied but is also the first overall picture of current and future EU copyright law. This Handbook will be of great interest to academics and intellectual property lawyers, as well as general commercial lawyers, across Europe because it reviews European directives in the field of copyright and also the relationships between copyright and other laws. Policymakers will also find much to interest them in the discussions regarding the future of EU copyright law and the proposed amendments to the existing legal framework.

Book Functionality Information Works and Copyright

Download or read book Functionality Information Works and Copyright written by Dana Beldiman and published by Lulu.com. This book was released on 2008 with total page 191 pages. Available in PDF, EPUB and Kindle. Book excerpt: It has become the practice to claim copyright protection for virtually every piece of 'writing' or its electronic equivalent, created by knowledge professionals - from business plans for a start-up company to the instruction manual for use of a motorized saw and to specifications for pipeline tenders. This paper posits that the legal doctrine of copyright was never intended, and is not equipped, to regulate the very building block of our society-information. When used to protect utilitarian information products (UIW) en masse, copyright can impede the flow of information necessary for innovation, foster waste in the form of redundant creation and adversely impact competition in the market.
