Este texto tiene vigencia en la actualidad y fue elaborado por la Asamblea Nacional Constituyente, compuesta por 559 diputados, y presidida por Ulysses Guimãres. La Constitución Federal de 1988 estableció que la República Federativa del Brasil se constituyera como un Estado Democrático de Derecho, inaugurando una nueva era en el constitucionalismo brasileño, rompiendo el ciclo autoritario que dominó el país de 1964 hasta mediados de la década de los ochenta. Su estructura difiere de las constituciones anteriores. Comprende nueve títulos, que tratan: 1) de los principios fundamentales; 2) de los derechos y garantías fundamentales, según una perspectiva moderna y que abarca los derechos individuales y colectivos, los derechos sociales de los trabajadores, la nacionalidad, los derechos políticos y de los partidos políticos; 3) de la organización del Estado, en la que estructura a la federación con sus componentes; 4) de la organización de los poderes: Poder Legislativo, Poder Ejecutivo y Poder Judicial, con la manutención del sistema presidencialista, derrotado el parlamentarismo. Contiene, además, un capítulo sobre las funciones esenciales de la Justicia, con ministerio público, abogacía pública (de la Unión y de los Estados), abogacía privada y defensa pública; 5) de la defensa del Estado y de las instituciones democráticas, con mecanismos del estado de defensa, del estado de sitio y de la seguridad pública; 6) de la tributación y del presupuesto; 7) del orden económico y financiero; 8) del orden social; 9) de las disposiciones generales. Finalmente, viene el Acto de las Disposiciones Transitorias. Ese contenido se distribuye en 245 artículos en la parte permanente, y 73 artículos más en la parte transitoria, reunidos en capítulos, secciones y sub-secciones.

Book excerpt: This book provides an overview of governance and development in the Mesoamerican Region (MAR), the design and scope of the Plan Puebla Panamá (PPP), its relationship to pre-existing regional organisms and its transformation into Proyecto Mesoamérica. The PPP was introduced as a holistic project that would reverse the cycles of poverty in Mesoamerica. However, the plan incited huge opposition from many groups within Mesoamerica, and throughout its duration few of its objectives were met. The author analyses the plan and describes the regional setting and precursors, as well as the US policy towards the Mesoamerican countries. Using this approach with an analysis of governance in Mesoamerica, this monograph shows a more complete picture of why this ambitious development project did not reach its goals and draws applicable insights to other regions where governance is complex.

Over this period dozens of scientists from different disciplines but with a common interest in rural issues and policy have collaboratively studied the policies in North America, Europe, and other parts of the world. A core element of the book is the idea and practice of comparative research and analysis – what can be learned from comparisons, how and why policies vary in different contexts, and what lessons might or might not be “transferable” across borders. It provides skills for the use of comparative methods as important tools to analyze the functioning of strategies and specific policy interventions in different contexts and a holistic approach for the management of resources in rural regions. It promotes innovation as a tool to valorize endogenous resources and empower local communities and offers case studies of rural policy in specific contexts. The book largely adopts a territorial approach to rural policy. This means the book is more interested in rural regions, their people and economies, and in the policies that affect them, than in rural sectors, and sectoral policies per se. The audience of the book is by definition international and includes students attending courses in agricultural and rural policy, rural and regional studies, and natural resource management; lecturers seeking course material and case studies to present to their students in any of the courses listed above; professionals working in the field of rural policy; policy-makers and civil servants at different levels seeking tools to better understand rural policy both at the local and global scale and to better recognize and comprehend how to transfer best practices.
