Non mancano interventi di peso, come quelli concernenti l’udienza di sentencing di cui all’art. 545-bis c.p.p. e la riforma dei meccanismi di sblocco della c.d. ‘‘stasi’’ al termine delle indagini preliminari. Composto di undici articoli - che introducono modifiche al codice penale, al codice di procedura penale e ad alcune leggi complementari e contengono norme transitorie – il correttivo interviene in tema di: pene sostitutive delle pene detentive brevi: i correttivi apportati seguono tre linee di intervento che interessano la fase di accesso alle pene sostitutive (meccanismo di sentencing, disciplina del giudizio di appello e concordato con rinuncia ai motivi di appello) e la revoca del beneficio per condanne sopravvenute; indagini preliminari: i profili di novità si articolano su più piani che si intersecano nel rinnovato sbilanciamento del processo nella fase delle indagini, contribuendo a realizzare quello che è stato definito il processo “a trazione anteriore”; processo in assenza: si tratta di integrazioni oggettivamente necessarie per garantire una maggior coerenza sistematica della normativa e porre rimedio ad una serie di difficoltà emerse nella prassi; procedimenti speciali: accanto a modifiche di mero coordinamento in tema di giudizio immediato, rito abbreviato e procedimento per decreto direttissimo, si collocano modifiche più incisive in punto di rito abbreviato e procedimento per decreto; presentazione dell’atto di impugnazione: per risolvere criticità pratiche, l’art. 10 D.Lgs. n. 31/2024 dispone che, fino a quando non sarà obbligatorio il deposito telematico degli atti, il procuratore generale presso la corte di appello può depositare l’atto di impugnazione nella cancelleria della corte di appello nella cui circoscrizione ha sede il giudice che ha emesso il provvedimento impugnato; giustizia riparativa: alcuni ritocchi alle previsioni del codice di rito nel segno della complementarità con la giustizia penale; difetti formali e di coordinamento: il decreto semplifica e di risolve alcuni problemi di coordinamento emersi in fase di prima applicazione della riforma ‘‘Cartabia’’, tenendo conto anche delle segnalazioni provenienti dal mondo accademico, dall’avvocatura e dalla magistratura. Book excerpt: This book argues that insufficient recognition of new families is a legal problem that needs fixing in light of recent evolutions in family patterns and normative conceptions of 'family'. People increasingly invest in relationships falling outside the model of the marital family, such as non-conjugal unions of friends or relatives, polyamorous relationships and various religious-based families. Despite this, Western jurisdictions retain the marital family as the relevant basis for allocating family law benefits, rights and obligations. Part I of the book illustrates recent evolutions in family patterns and norms, and explores how law can accommodate multiple family grids without legal recognition involving normalisation. Part II focuses on courtroom litigation on the basis that courts nowadays are central avenues of social change. It takes non-conjugal families as a case study and provides an analysis of the most compelling argumentative strategies that non-conjugal families can mobilise to pursue legal recognition in Canada and the United States, and within the systems of the European Convention of Human Rights and the European Union. Through its comparative, interdisciplinary and critical legal method, the book provides scholars, activists and policymakers with conceptual tools to tackle the current invisibility of new families. Further, by advancing legal arguments to enhance the protection of non-conjugal families in courtrooms, the book illuminates the different approaches jurisdictions are likely to take and the hindrances thereof to overcome and debunk stereotypes associated with proper familyhood.

Book excerpt: Liability and Environment analyzes the role of law, in particular civil liability, in controlling environmental pollution and risk. In modern environmental policy, liability has become a popular instrument. In this book, Prof. Bergkamp takes a fresh look at civil liability for environmental harm in an inter- and transnational context. Over the last decade, industry's liability exposure for environmental harm has expanded significantly. At the international, EC, and national level proposals for onerous strict environmental liability regimes are pending. The `polluter pays principle', which is an articulation of the `cost internalization' theory in the environmental area, is believed to justify such liability regimes. Applying an instrumental approach to legal instruments, Prof. Bergkamp aims to redefine the role of liability in the heavily regulated environmental area. He shows that liability for environmental harm is not justified by the polluter pays principle, is an uncertain and unreliable instrument for achieving prevention, results in an inefficient insurance scheme, and plays a dubious role in adjusting activity levels. Based on an analysis of the basic characteristics of alternative legal instruments, Prof. Bergkamp concludes that civil liability should play a more modest, limited role in an environmental law system dominated by public law. Where deterrence is not the objective, first party insurance, compensation funds, or other public law regimes should be preferred over liability rules. In addition to civil liability of private parties, Liability and Environment discusses State liability under international, EC, and national law. Under international law, breach of a primary obligation triggers a State's liability. Prof. Bergkamp argues that this rule should be applied also to liability of private parties. In the environmental area, a business' primary obligations are spelled out in detailed permit conditions, regulations, and statutes. According to Prof. Bergkamp, only if a primary obligation is breached, a private person should be liable for environmental harm. The system that Bergkamp advocates is an objective fault liability regime, in which public environmental law defines the standard of care for both government and industry. "In rebuilding our civil liability system, we should keep in mind that what is good for industry should be good for everyone (or it is not good for anyone), we should keep in mind that what is good for private parties should be good for the state (or it is not good for either). In rebuilding our civil liability system, the international law of State responsibility, which is unpolluted by risk spreading and activity level considerations, will guide us a long way." This book is aimed at advanced law students, academic scholars, and practitioners. In addition, it will be of interest to policy and legislative analysts, legislators, and government officials. Professor Bergkamp's book cannot be described as "solving" the problems of legal and regulatory control of environmental harm, whether within a nation or internationally. As suggested before, however, the very idea of a "solution" is illusory. All legal and regulatory regimes around the world are today and will remain for the future in a state of perpetually continuing development. The virtue of this fine book is that it moves the process of that development forward by a very substantial measure. from the Foreword by George L. Priest.
