Book excerpt: The Sewel Convention seeks to ensure that the UK Parliament legislates on devolved matters only with the express agreement of the Scottish Parliament, and consent is also required for legislation on reserved matters if it alters the powers of the Scottish Parliament or Scottish Ministers. Following on from a report by the Scottish Parliament Procedures Committee on the operation of the Convention (SP paper 428, 7th report, session 2 (2005) (ISBN 1406113220) published in October 2005), the Committee's report focuses on ways of improving the communications procedure between the Scottish and Westminster Parliaments, and how MPs could be better alerted that a particular Bill before Parliament had been subject to a Sewel motion in the Scottish Parliament. Recommendations made include: the introduction of a formal process whereby the Scottish Parliament notifies Westminster when a Sewel motion has been passed and the 'tagging' of all relevant public Bills; and the need for an explicit statement on explanatory notes to Bills as to which parts of the UK the provisions will affect. The report also recommends the further consideration of the need to establish a 'Super' Scottish Grand Committee, composed of Scottish MPs, MSPs and Scottish MEPs, to discuss matters of mutual interest.

Book excerpt: The House should be given the opportunity to restate its acceptance of the principle behind the proposal that lay members be added to the Committee on Standards and Privileges, the Procedure Committee concludes in a report published today. The committee's report responds to the resolution of the House of 2 December last year that lay members should sit on the Committee on Standards and Privileges. If that principle is restated, the House should study with care the arguments made for the inclusion of lay members with or without voting rights, and decide whether lay members should be appointed to the committee with full voting rights or whether they should be appointed with more limited rights protected by rules on quorum and publication of their opinion or advice. A decision in favour of membership with full voting rights would require legislation to be brought forward to put beyond reasonable doubt any question of whether parliamentary privilege applies to the Committee on Standards where it has an element of lay membership. The Procedure Committee recommends that the Committee on Standards and Privileges should be split in two, and that lay members should be included only on the committee relating to standards. The committee also makes a number of practical recommendations about the number, appointment and term of office of lay members.

Book excerpt: This report examines the recommendations of the Commission on Scottish Devolution ('the Calman Commission'), specifically the parts which relate to relations between the two parliaments. The Scottish Affairs Committee concludes that closer cooperation between the UK and Scottish parliaments and governments is only possible if backed up by political will. Removing procedural barriers is only one part of improving communication and cooperation; structural changes alone will not make the difference. The Committee's key findings are: the Government should make time for a regular 'State of Scotland' debate, to include devolved matters; The UK and Scottish governments have given a positive response to the idea of appearing before committees of either Parliament; the idea of a 'Scottish Super Grand Committee' composed of Scottish MPs, MSPs and Scottish MEPs should be revisited; changes should be made to allow UK and Scottish parliamentary committees to work together; positive consideration should be given to whether Scottish ministers can give evidence to UK Parliament committees examining Scotland Act Orders; arrangements should be made to remove any unnecessary barriers to access for MSPs visiting Westminster; a programme of exchanges and secondments with the Scottish Parliament should be funded and encouraged by the House.

Book excerpt: In this report the Public Administration Select Committee (PASC) argues that the Government appoints too many ministers and should reduce their number by the middle of the Parliament, As it devolves real power and responsibility to local communities. And following the decision to cut the number of MPs in the House of Commons from 650 to 600, The Committee finds further scope for reductions. 141 MPs are currently on the 'payroll vote' as ministers or their Parliamentary aides. If this number remains static at the same time as MPs are cut, it will effectively increase the payroll vote - further strengthening the Executive at the expense of Parliament. PASC urges three steps on the Government to reduce this power of patronage: The current legal cap on the number of paid ministers should set the absolute limit; the legal limit on the number of ministers in the Commons should be cut by eight; the number of PPSs should be limited to one per department - a reduction of 26. The report recommends a review of ministerial numbers to reflect the smaller government. Ministers' time is not always well spent and the report identifies a number of ways in which the Government could therefore refocus ministers' work and make them more effective. The Committee believes it should ultimately be possible to cut the number of ministers to a total of 80, shared between the Commons and the Lords.

Book excerpt: Whilst welcoming the motivation behind the Manual and the transparency it brings to the workings of Government, the Committee says that in practice the Manual may be treated as having greater authority than originally intended, particularly where its content extends beyond matters purely for the Executive. All the work of the Executive, including the Cabinet Manual , is subject to scrutiny by Parliament. The fact that the document is primarily directed at the Executive does not exempt it from this scrutiny. The Committee makes some practical suggestions for specific improvements to the text, focusing particularly on the chapters covering government formation and ministers and Parliament. The Committee also challenges some of the specific content of the draft: the failure to include the convention, acknowledged elsewhere by the Government, that Parliament should have the opportunity to debate decisions to commit troops to armed conflict; guidance on when a Prime Minister should resign following a hung Parliament. The Committee recommends that the House should hold a regular debate on the Manual. The Committee felt, despite dissatisfaction with parts of the original draft, there was no reason to delay production of an approved version. The new version need not be perfect as it will be subject to further review.
