He points out protections afforded members other than parliamentary privilege and the view of both the courts and the legislatures concerning parliamentary debates and proceedings as evidence in court. He also sets out in detail what the House of Commons considers to be and not to be a matter of privilege, as well as the corporate powers of the Houses of Parliament.

Book Parliamentary Procedure and Practice in the Dominion of Canada

Download or read book Parliamentary Procedure and Practice in the Dominion of Canada written by John George Bourinot and published by The Lawbook Exchange, Ltd.. This book was released on 2008 with total page 716 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Though mainly a book of practice, it is, however, by no means a mere epitome of rules of procedure. Enlarging upon the example of Sir Erskine May, Mr. Bourinot outlines the whole political system of the Dominion; and within the wide field thus surveyed, there is much of the deepest interest to students and reformers of parliamentary institutions at home."--A. H. B. Constable, The Juridical Review 4 (1893) 273. "The object which the author has had constantly in view...is to give such a summary of the rules and principles which guide the practice and proceedings of the Parliament of Canada as will assist the parliamentarian and all others who may be concerned in the working of our legislative system. (...) It is, moreover, been the writer's aim, not only to explain as fully as possible the rules and usages adopted in Canada, but also to give such copious references to the best authorities...as will enable the reader to compare Canadian with British procedure." --Preface, xi. Sir John George Bourinot [1836-1902] founded the Evening Reporter with Joseph C. Crosskill in 1860 and was a founding member and honorary secretary of the Royal Society of Canada. He wrote many distinguished books on Canadian political history. Two of them, How Canada is Governed (1895) and Canada Under British Rule, 1760-1900 (1900), were standard references for decades. Thomas Barnard Flint [1847-1919] was a lawyer and politician in Nova Scotia, Canada. He was assistant clerk for the Nova Scotia House of Assembly from 1887-1891. In 1902 he was named Clerk of the House of Commons and remained in that position until 1918.

Book excerpt: The publication of Parliamentary Privilege in Australia in 1966 established Enid Campbell as the country's leading scholar in the area. Now Professor Campbell has written a successor which, while drawing on parts of the earlier work, focusses on issues and problems which have arisen in recent years, particularly since the enactment of the Commonwealth Parliamentary Privileges Act 1987. Topics specifically examined in the book include - the scope of the central privilege of freedom of speech and debate in parliament; measures adopted by houses of parliaments to regulate exercise of that freedom; restrictions on the uses which may be made of evidence of what has been said and done in the course of parliamentary proceedings; immunities accorded to MPs in respect of various legal processes, such as ones which require them to appear before a court to give evidence; the powers of houses of parliaments to make inquiries and to delegate investigatory powers to committee of their members; the power of houses of parliaments to impose penalties of a criminal character and to discipline their members. This book, like its predecessor, will be the standard reference on the laws concerning the powers, privileges and immunities of Australian parliaments, their members and committees for the next generation.

Available in PDF, EPUB and Kindle. Book excerpt: With nearly 600 cross-referenced entries, The Language of Canadian Politics offers brief essays on the many facets of the Canadian political system, including institutions, events, laws, concepts, and public policies. Concisely written, it is an important resource for people interested in contemporary politics, as well as those interested in the historic context of contemporary political behaviour. The Sponsorship Scandal and the Gomery reports are included in several entries. There is new information on National Security Certificates, and the O’Connor inquiry into the "extraordinary rendition" of Maher Arar comprises part of the revised material on commissions of inquiry. As a further resource, Internet sites have been added to many of the entries.

Book Seven Absolute Rights

Download or read book Seven Absolute Rights written by Ryan Alford and published by McGill-Queen's Press - MQUP. This book was released on 2020-05-21 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: For 150 years, Canada's constitutional order has been both flexible and durable, ensuring peace, order, and good government while protecting the absolute rights at the core of the rule of law. In this era of transnational terrorism and proliferating emergency powers, it is essential to revisit how and why our constitutional order developed particular limits on the government's powers, which remain in force despite war, rebellion, and insurrection. Seven Absolute Rights surveys the historical foundations of Canada's rule of law and the ways they reinforce the Constitution. Ryan Alford provides a gripping narrative of constitutional history, beginning with the medieval and early modern context of Magna Carta, the Petition of Right, and the constitutional settlement of the Glorious Revolution. His reconstruction ends with a detailed examination of two pre-Confederation crises: the rebellions of 1837–38 and the riots of 1849, which, as he demonstrates, provide the missing constitutionalist context to the framing of the British North America Act. Through this accessible exploration of key events and legal precedents, Alford offers a distinct perspective on the substantive principles of the rule of law embedded in Canada's Constitution. In bringing constitutional history to life, Seven Absolute Rights reveals the history and meaning of these long-forgotten protections and shows why they remain fundamental to our freedom in the twenty-first century.
