Promoting and increasing investment in the renewable energy sector is crucial for limiting global temperature rise to 1.5°C and addressing energy poverty in the Global South. In this volume, Avidan Kent explores the various home-country measures (HCMs) offered by international law that support FDI in the renewable energy sector. This book provides a bird’s eye evaluation of HCMs from fields such as trade law, investment law, environmental law, development law and more. It reveals that while international law indeed offers many legal tools to support investors’ needs, the current legal framework is fragmented; most legal instruments were designed in isolation and the potential for mutually supportive, synergetic policies has been explored only to a limited extent. This fragmented reality is in contradiction to the notion of Policy Coherence for Development, which is increasingly gaining support in leading institutions in Europe and elsewhere. This book will provide recommendations on the manner in which HCMs can be connected in order to maximise their potential and boost investment in renewable energies in the developing world. Book excerpt: The main question explored by the book is: How can cross-border access to human genetic resources, such as blood or DNA samples, be governed in such a way as to achieve equity for vulnerable populations in developing countries? The book situates the field of genomic and genetic research within global health and research frameworks, describing the concerns that have been raised about the potential unfairness in exchanges during recent decades. Access to and sharing in the benefits of human biological resources are aspects not regulated by any international legal framework such as the Convention on Biological Diversity, which applies only to the exchange of plants, animals and microorganisms, as well as to associated traditional knowledge. Examples of genetic research perceived as exploitative are provided in order to illustrate the legal vacuum concerning the global governance of human genetic resources. The main conclusions drawn from the legal and ethical analysis are: • Benefit sharing is crucial in order to avoid the exploitation of developing countries in human genetic research. • With functioning research ethics committees, undue inducement is less of a concern in genetic research than in other areas of medical research (e.g. clinical trials). • Concerns remain over research involving indigenous populations; accordingly, recommendations are provided. In drawing these conclusions, the book addresses in detail a highly pressing topic in global bioethics and international law. In this regard, it combines bioethical arguments with jurisprudence, in particular with reference to the law of equity and the legal concepts of duress (coercion), unconscionable dealing, and undue inducement.

Book excerpt: The marine areas beyond national jurisdiction (ABNJ) comprise 40 percent of the earth’s surface, covering 64 percent of the surface of the ocean and 95 percent of its volume. The Common Oceans ABNJ Programme (2014-2019) was implemented by FAO as a concerted effort to bring stakeholders to work together to manage and conserve the world’s common oceans. The ABNJ Tuna project, one component of the Common Oceans ABNJ Programme, promoted important transformational changes in the management practices of tuna fisheries, improving their sustainability, strengthening Marine Stewardship Council capabilities of tuna regional fisheries management organizations (t-RFMOs) and their members, and significantly reducing their impact on biodiversity. The project generated knowledge but lacked a structured mechanism and strategy to harvest and disseminate it. Similarly to the programme level evaluation report, the programmatic approach component, the partnership framework, as well as how to foster synergies among projects and capitalization of knowledge management should be strengthened.
