Mais il pressent qu’il est une situation pire que le procès : le déni de justice. Lorsque, formellement, le juge refuse de statuer ou lorsque, matériellement, il rend une justice qui n’est qu’un simulacre, tant est palpable l’arbitraire qui l’entache, c’est non seulement la tentation de la justice privée qui menace mais plus radicalement la révolte des citoyens, comme le montre la belle nouvelle de Kleist, Michael Kolhaas, autour de laquelle Mme Lycette Corbion a construit son introduction. Aussi bien, en droit interne, la proclamation solennelle de l’article 4 du Code civil, elle-même sanctionnée pénalement, montre-t-elle que le législateur français a une conscience claire du problème. Mais qu’en est-il au plan international ? Morceau obligé des ouvrages de droit international privé, le déni de justice n’occupe au sein de ceux-ci qu’une place modeste. Et de fait, chef de compétence exceptionnel, le déni de justice a permis à la fin du xixe siècle de donner un juge aux étrangers malgré le principe d’incompétence des tribunaux français qui les frappait. Limitée, l’hypothèse est, au surplus, très datée. Aussi aurait-on pu douter qu’il y ait là matière à une thèse. La première à tenter l’expérience, Mme Lycette Corbion a apporté la démonstration du contraire. Bien loin de se laisser arrêter par l’aspect apparemment étroit d’un tel sujet, elle en a perçu toutes les potentialités. Prisme à travers lequel il est possible de reconsidérer aussi bien l’histoire de la discipline que ses fondements, le déni de justice trouve dans le droit international privé un terreau particulièrement fertile. On sait, en effet, que si les relations de plus en plus nombreuses que les hommes nouent à travers les frontières donnent naissance à une société propre, la société internationale, il n’existe pas, pour l’heure, d’autorité unique pour traiter ces relations, en sorte que c’est aux États eux-mêmes qu’il appartient de les prendre en charge. D’où des risques accrus de lacunes et de cumuls, spécialement en matière de conflit de juridictions du fait du caractère unilatéral des règles qui les régissent. Au surplus, si le droit international privé ne se désintéresse pas de la justice matérielle, il s’emploie d’abord à promouvoir une justice du droit international privé, ce qui n’est pas sans susciter des interrogations quant à la notion de justice qui est alors appelée à servir d’instrument de référence.

Book excerpt: Le droit international privé français tient pour usuel la dissociation entre le conflit de lois et le conflit de juridictions. Cette indépendance entre les deux corps de règles est érigée en principe tant par la doctrine majoritaire que par le droit positif. Selon ce principe, toute forme de corrélation est et doit être réfutée, qu'elle opère au moment de la mise en œuvre des règles de conflit ou de leur construction. En d'autres termes, ce sont ainsi trois hypothèses qui sont dénoncées : celle de l'applicabilité directe de la lex fori en tant que telle, mais également celles de la compétence du forum legis et du parallélisme des règles de conflit, celles-ci conduisant à une applicabilité indirecte de la lex fori. Or, selon la présente étude, le droit international privé des obligations montre qu'un tel principe n'existe pas et qu'il n'est pas nécessairement opportun. En effet, et un tel constat s'impose, tant le mécanisme des lois de police que le jeu de l'autonomie de la volonté suscitent une applicabilité directe de la lex fori. Par ailleurs, la réfutation des modes de corrélation indirecte est inopportune. D'une part, la compétence du forum legis permet de garantir l'effectivité des lois de police, dans la mesure où aucun autre remède ne se révèle suffisant. D'autre part, la spécialisation du droit international privé des obligations et l'emprise du droit de l'Union européenne sur cette discipline génère des règles de compétence et de loi applicable qui présentent un certain parallélisme qui n'est pas uniquement accidentel. La thèse invite ainsi à remettre en question certains dogmes classiques du droit international privé des obligations.
