Book excerpt: Le questionnement autour de l'influence du principe de précaution sur la responsabilité juridique s'est posé, à la fois dans le discours doctrinal et dans la pratique judiciaire, au constat du renouvellement des risques de dommage qu'entraîne l'évolution technologique pour l'environnement et le vivant. Face à une demande répressive et indemnitaire croissante en provenance du corps social, la question est de savoir si le principe de précaution est à même d'engendrer un renouvellement de la responsabilité juridique, civile et pénale. Combinant une approche pluridisciplinaire et une méthode comparative, cet ouvrage se propose un double objectif. Saisir tout d'abord la portée et le contenu normatif du principe de précaution à travers l'étude de ses dynamiques normatives : circulation horizontale entre les différentes branches du droit international et circulation verticale du droit international et européen vers le droit national. Repérer ensuite les métamorphoses de la responsabilité juridique que le principe de précaution est susceptible d'engendrer à l'échelle nationale, le terme métamorphoses désignant, à l'instar des sciences du vivant, moins le résultat que les processus de transformation de la responsabilité juridique. A partir de l'analyse du processus de transformation, de changement, de façonnement de ce droit "vivant", la recherche vise à repérer, interroger et encadrer les limites de l'influence du principe de précaution sur le droit de la responsabilité, et notamment sur les sources et la mise en oeuvre de la responsabilité pénale. Dans cette perspective elle rend compte des acquis, théoriques et pratiques, dans le domaine de la responsabilité - civile et pénale - au regard de l'expérience française et comparée (Italie, Espagne, Chine et Argentine).

Cette étude a alors pour but de rendre compte de l'originalité de ce nouveau principe juridique et des rapports à la fois riches et complexes qu'il entretient avec le droit de la responsabilité civile, dont le but est, au contraire, en premier lieu indemnitaire. Dans une première partie de l'étude, Mme Boutonnet prend acte de l'émergence du principe de précaution en droit de la responsabilité civile comme principe consistant, aujourd'hui, à prévenir les dommages graves dans les domaines de l'environnement, de la santé et de la bioéthique, lorsque ces derniers atteignent certains intérêts collectifs. A ce titre, comme le montre la seconde partie de l'étude, le principe de précaution pourrait entraîner des conséquences en droit de la responsabilité civile. Au minimum, dans une finalité réparatrice, il renouvellerait l'appréciation du fait générateur, du dommage et du lien de causalité. Au maximum, il pourrait devenir un nouveau principe du droit de la responsabilité civile dont il découlerait une action préventive et collective. L'étude envisage alors la nature et le régime de cette nouvelle action en responsabilité civile, tout en démontrant que cette évolution s'effectuerait avec souplesse.

En dépit de la cristallisation de la loi, cette matière a constitué un laboratoire privilégié de création jurisprudentielle. La Cour de cassation a, en effet, œuvré dans le sens de l’adaptation de la responsabilité civile à l’évolution des besoins de la société. La responsabilité du fait des choses inanimées ou encore les dommages causés par les accidents de la circulation sont autant de constructions prétoriennes audacieuses.Ce travail de recherche a pour objet d’analyser la capacité créative prétorienne par rapport aux nouveaux besoins sociaux qu’est l’évitement de certains dommages. En sus de la nécessaire indemnisation, l’évitement de certains dommages est devenu un enjeu majeur, particulièrement dans les domaines de la santé publique et environnemental. C’est alors que le juge, dans le silence de la loi mais avec l’aide précieuse des progrès scientifiques, au lieu d’évaluer les dommages, se livre à une analyse du risque hypothétique; au lieu d’indemniser les dommages, met tout en œuvre pour les éviter.Dans cette perspective, ce travail de recherche a pour ambition de proposer l’intégration d’une action de précaution en droit français. Cette action présenterait l’incommensurable avantage de doter les citoyens d’un outil juridique nécessaire pour éviter la réalisation des dommages litigieux aux conséquences graves et irréversibles. Le risque serait alors érigé au rang des conditions de la responsabilité civile et les mesures pour éviter le dommage constitueraient, quant à elles, les effets de la responsabilité. De sorte que coexisteraient, au sein de la matière, la fonction traditionnelle indemnitaire et la fonction nouvelle d’évitement des dommages.

The Shari'a includes many excellent provisions about declarations of war, treaties of peace, armistices, diplomatic envoys, negotiations and guarantees of safe conduct. But the fact remains that it divides the world, broadly speaking, into the "Abode of Islam" and the "Abode of 'War," and that it envisages the continu ance of intermittent war between them until the latter is absorbed in the former. In the course of such fighting, and in the intervals in be tween, many civilities were to be meticulously observed; but prisoners of war could be killed, sold or enslaved at the discretion of the Muslim authorities, and the women of those who resisted the advance of Islam could be taken as slave-concubines, regardless of whether they were single or married. The "Abode of Islam" did not, indeed, consist ex clusively of Muslims, for those whose religion was based on a book accepted by Islam as originally inspired and in practice, indeed, those other religions too - were not forced to embrace Islam but only to accept Muslim rule. They were granted the status of dhimmis, were protected in their persons and their property, were allowed to follow their own religion in an unobtrusive fashion, and were accorded the position of essentially second-class citizens. They were also of course, perfectly free to embrace Islam; but for a Muslim to be converted to another faith involved the death penalty.
