The package of laws represents a threat to the right to freedom of expression. It creates a system of media content regulation and compulsory media registration, and introduces a powerful Media Authority without ensuring the necessary safeguards that these instruments will not lead to interference with internationally protected human rights. Hungary has an obligation to respect, protect and fulfill the right to freedom of expression which, as outlined in international human rights law, includes the freedom to seek, receive and impart information and ideas of all kinds. A free, uncensored and unhindered press and other media is essential for the effective exercise of this right.

Book excerpt: Having won a two-third majority in Parliament at the 2010 elections, the Hungarian political party Fidesz removed many of the institutional obstacles of exerting power. Just like the party, the state itself was placed under the control of a single individual, who since then has applied the techniques used within his party to enforce submission and obedience onto society as a whole. In a new approach the author characterizes the system as the ?organized over-world?, the ?state employing mafia methods? and the ?adopted political family', applying these categories not as metaphors but elements of a coherent conceptual framework. The actions of the post-communist mafia state model are closely aligned with the interests of power and wealth concentrated in the hands of a small group of insiders. While the traditional mafia channeled wealth and economic players into its spheres of influence by means of direct coercion, the mafia state does the same by means of parliamentary legislation, legal prosecution, tax authority, police forces and secret service. The innovative conceptual framework of the book is important and timely not only for Hungary, but also for other post-communist countries subjected to autocratic rules. ÿ

They attempt to understand the reasons behind public discourses that increasingly reframe politics in terms of nationhood and nationalism. Overall, the volume attempts to explain how the new nationalism is rooted in recent political, economic and social processes. The contributors focus on two motifs in public discourse: shift and legacy. Some focus on shifts in public law and shifts in political ethno-nationalism through the lens of constitutional law, while others explain the social and political roots of these shifts. Others discuss the effects of legacy in memory and culture and suggest that both shift and legacy combine to produce the new era of identity politics. Legal experts emphasize that the new Fundamental Law of Hungary is radically different from all previous Hungarian constitutions, and clearly reflects a redefinition of the Hungarian state itself. The authors further examine the role of developments in the fields of sociology and political science that contribute to the kind of politics in which identity is at the fore.

Book excerpt: More than two decades after the post-communist constitutional transition, Hungary got into the spotlight again. As a result of the 2010 elections, the governing majority gained two-thirds of the seats in parliament, which made constitutional revision exceptionally easy, bypassing extensive political and social deliberations. In April 2011, on the first anniversary of the 2010 election, a brand new constitution was promulgated, named the Fundamental Law. This collection is the most comprehensive account of the Fundamental Law and its underlying principles. The objective is to analyze this constitutional transition from the perspectives of comparative constitutional law, legal theory and political philosophy. The authors outline and analyze how the current constitutional changes are altering the basic structure of the Hungarian State. The key concepts of the theoretical inquiry are sociological and normative legitimacy, majoritarian and partnership approach to democracy, procedural and substantive elements of constitutionalism. This empirical study of gyűlöletbeszéd, or "hate speech," in Hungary documents competing meanings of the term, the interpretive strategies used to generate those competing meanings, and the parallel moral systems that inspire political actors to question their opponents’ interpretations. In contrast to most existing treatments of the subject, Boromisza-Habashi’s argument does not rely on pre-existing definitions of "hate speech." Instead, he uses a combination of ethnographic and discourse analytic methods to map existing meanings and provide insight into the sociocultural life of those meanings in a troubled political environment.

Since 2010, Viktor Orbán’s governments in Hungary have convincingly offered an anti-modernist and anti-cosmopolitan/anti-European Unionist rhetoric, discourse and constitutional identity to challenge neo-liberal democracy. The Hungarian case provides unique observation points for students of transitology, especially those who are interested in states which are to abandon pathways of liberal democracy. The author demonstrates how illiberalism is present both in `how’ and `what’ is being done: the style, format and procedure of legislation; as well as the substance: the dismantling of institutional rule of law guarantees and the weakening of checks and balances. The book also discusses the ideological commitments and constitutionally framed and cemented value preferences, and a reconstituted and re-conceptualized relationship between the state and its citizens, which is not evidently supported by Hungarians’ value system and life-style choices.

Book excerpt: The volume presents the changing situation of the Roma in the second half of the 20th century and examines the politics of the Hungarian state regarding minorities by analyzing legal regulations, policy documents, archival sources and sociological surveys. In the first phase analyzed (1945-61), the authors show the efforts of forced assimilation by the communist state. The second phase (1961-89) began with the party resolution denying nationality status to the Roma. Gypsy culture was equivalent with culture of poverty that must be eliminated. Forced assimilation through labor activities continued. The Roma adapted to new conditions and yet kept their distinct identity. From the 1970s, Roma intellectuals began an emancipatory movement, and its legacy is felt until this day. Although the third phase (1989-2010) brought about freedoms and rights for the Roma, with large sums spent on various Roma-related programs, the situation on the ground nevertheless did not improve. Segregation and marginalization continues, and it is rampant. The authors powerfully conclude: while Roma became part of the political community, they are still not part of the national one.
