Book excerpt: Power sharing may be broadly defined as any set of arrangements that prevents one political agency or collective from monopolizing power, whether temporarily or permanently. Ideally, such measures promote inclusiveness or at least the coexistence of divergent cultures within a state. In places deeply divided by national, ethnic, linguistic, or religious conflict, power sharing is the standard prescription for reconciling antagonistic groups, particularly where genocide, expulsion, or coerced assimilation threaten the lives and rights of minority peoples. Book excerpt: Civil Paths to Peace contains the analyses and findings of the Commonwealth Commission on Respect and Understanding, established in response to the 2005 request of Commonwealth Head of Government for the Commonwealth Secretary-General to 'explore initiatives to promote mutual understanding and respect among all faiths and communities in the Commonwealth.' This report focuses particularly on the issues of terrorism, extremism, conflict and violence, which are much in ascendancy and afflict Commonwealth countries as well as the rest of the world. It argues that cultivating respect and understanding is both important in itself and consequential in reducing violence and terrorism. It further argues that cultivated violence is generated through fomenting disrespect and fostering confrontational misunderstandings. The report looks at the mechanisms through which violence is cultivated through advocacy and recruitment, and the pre-existing inequalities, deprivations and humiliations on which those advocacies draw. These diagnoses also clear the way for methods of countering disaffection and violence. In various chapters the different connections are explored and examined to yield general policy recommendations. Accepting diversity, respecting all human beings, and understanding the richness of perspectives that people have are of great relevance for all Commonwealth countries, and for its 1.8 billion people. They are also importance for the rest of the world. The civil paths to peace are presented here for use both inside the Commonwealth and beyond its boundaries. The Commonwealth has survived and flourished, despite the hostilities associated with past colonial history, through the use of a number of far-sighted guiding principles. The Commission argues that those principles have continuing relevance today for the future of the Commonwealth--and also for the world at large.

Book excerpt: Why does religion become a fault line of communal violence in some pluralistic countries and not others? Under what conditions will religious identity - as opposed to other salient ethnic cleavages - become the spark that ignites communal violence? Contemporary world politics since 9/11 is increasingly marked by intra-state communal clashes in which religious identity is the main fault line. Yet, violence erupts only in some religiously pluralistic countries, and only in some parts of those countries. This study argues that prominent theories in the study of civil conflict cannot adequately account for the variation in subnational identity-based violence. Examining this variation in the context of Nigeria's pluralistic north-central region, this book finds support for a new theory of power-sharing. It finds that communities are less likely to fall prey to a divisive narrative of religious difference where local leaders informally agreed to abide by an inclusive, local government power-sharing arrangement.

Book excerpt: Looking at the growing use of federalism and decentralization as tools of conflict resolution, this book provides evidence from several case studies on the opportunities and challenges that territorial solutions offer when addressing internal conflicts within a variety of countries. Federalism has been used as a tool of conflict resolution in a number of conflict situations around the world. The results of this have been mixed at best, with some countries moving slowly to the paths of peace and recovery, while others have returned to violence. This volume looks at a number of case studies in which federalism and decentralization have been promoted in order to bring opposing groups together and protect the territorial integrity of different countries. Yet, it is demonstrated that this has been incredibly difficult, and often overshadowed by wider concerns on secession, de and re-centralization and geopolitics and geoeconomics. While federalism and decentralization might hold the key to keeping war-torn countries together and bringing hostile groups to the negotiation table, we nevertheless need to rethink under which conditions territorial autonomy can help to transform conflict and when it might contribute to an increase in conflict and violence. Federalism alone, so the key message from all contributions, cannot be enough to bring peace – yet, without territorial solutions to ongoing violence, it is also unlikely that peace will be achieved. The chapters in this book were originally published as a special issue of Ethnopolitics.

Current examples include Belgium, Bosnia, Northern Ireland, Burundi, and Iraq. Despite their growing popularity, they have begun to be challenged before human rights courts as being incompatible with human rights norms, particularly equality and non-discrimination. Courts and Consociations examines the use of power-sharing agreements, their legitimacy, and their compatibility with human rights law. Key questions include to what extent, if any, consociations conflict with the liberal individualist preferences of international human rights institutions, and to what extent consociational power-sharing may be justified to preserve peace and the integrity of political settlements. In three critical cases, the European Court of Human Rights has considered equality challenges to important consociational practices, twice in Belgium and then in Sejdic and Finci v Bosnia regarding the constitution established for Bosnia Herzegovina under the Dayton Agreement. The Court's decision in Sejdic and Finci has significantly altered the approach it previously took to judicial review of consociational arrangements in Belgium. This book accounts for this change and assess its implications. The problematic aspects of the current state of law are demonstrated. Future negotiators in places riven by potential or actual bloody ethnic conflicts may now have less flexibility in reaching a workable settlement, which may unintentionally contribute to sustaining such conflicts and make it more likely that negotiators will consider excluding regional and international courts from reviewing these political settlements. Providing a clear, accessible introduction to both the political use of power-sharing settlements and the human rights law on the issue, this book is an invaluable guide to all academics, students, and professionals engaged with transitional justice, peace agreements, and contemporary human rights law.

Book excerpt: The recent efforts to reach a settlement of the enduring and tragic conflict in Darfur demonstrate how important it is to understand what factors contribute most to the success of such efforts. In this book, Caroline Hartzell and Matthew Hoddie review data from all negotiated civil war settlements between 1945 and 1999 in order to identify these factors. What they find is that settlements are more likely to produce an enduring peace if they involve construction of a diversity of power-sharing and power-dividing arrangements between former adversaries. The strongest negotiated settlements prove to be those in which former rivals agree to share or divide state power across its economic, military, political, and territorial dimensions. This finding is a significant addition to the existing literature, which tends to focus more on the role that third parties play in mediating and enforcing agreements. Beyond the quantitative analyses, the authors include a chapter comparing contrasting cases of successful and unsuccessful settlements in the Philippines and Angola, respectively.
