While the amount of cross-national comparative research has continued to grow, especially in Europe, remarkably little attention has been devoted to epistemological and methodological questions. Papers in this book by historians, sociologists, economists and political scientists aim to contribute to this insufficiently explored research topic. Drawn from various European countries, they explain how they construct their research objects. They address the role of languages in comparative research and they all try to reach beyond the opposition between universalism and culturalist relativism or particularism. The authors draw on their extensive empirical knowledge to produce a useful instrument for researchers. The Council of Europe suggests reconciling social cohesion with the inevitable changes wrought by globalisation, namely the reorganisation of the parameters governing competition. This reconciliation should take into account the essential political value of democratic security, to be found firstly in employment; the high social and societal cost of precariousness attests to this. However, security should not imply rigidity. It should rather translate into societal recognition of a "right to transition" which calls for co-responsibility on the part of all social actors and stakeholders. Reconciliation is more than a political duty, it is a prerequisite for the stability necessary for social sustainability. It should therefore raise awareness of the need to find new ways of fairly sharing the costs and benefits such transitions create. -- Council of Europe.

After almost three decades of deregulation driven by a belief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and institutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are, in turn, historical, comparative, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to participate in the economic life of the polity. In modern legal systems, 'capacity' is the principal juridical mechanism by which individuals and entities are empowered to enter into legally binding agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to involvement in the operations of a market economy.

There are only, as a hang-over from the French and Italian colonialist past, certain Dec1arations, in the Appendices, regard ing a possible association of Tunis, Morocco, Libya with the new under taking. And, of course, there is Artic1e 113 prescribing, at the end of the Community's transition period, the common trade policy - plus the Artic1e (238) giving blanket authorisation for association agreements. These legal prescriptions were duly implemented in the Association Agreements with Greece (1961) and Turkey (1963) and have supplied the basis for bilateral instruments in respect of other Mediterranean lands - ad hoc, pragmatic ar rangements. In the circumstances the Community could scarcely have proceeded otherwise. Yet the outlines of a European economic policy with regard to the countries of the Mediterranean basin were there from the beginning -limited, however, over the years by the internal development of the Community itself. One is reminded in this connection of sundry invoca tions by European and Mediterranean personalities and members of the European Commission - and, specifically, of a Memorandum presented by Italy to the Council of Ministers in 1964.

This text examines the social and economic consequences of this employment flexibility. The book derives from the 2nd Anglo-French Conference on the Transferability of Social Policy held in 1998, which focused on the problems created by employment flexibility and the appropriate policy responses, it also presents commentaries on the consequences of flexibility in Britain and France. It brings together British and French perspectives on such policy questions as the impact on families and their ability to plan in an atmosphere of economic insecurity, the manner in which French and British welfare systems are adapting, the impact on citizens' rights, the need, in both countries, to make pension arrangements more adaptable, and the potential for a "European citizenship" approach to the problem.
