Book excerpt: In The Politics of Islamic Law, Iza Hussin compares India, Malaya, and Egypt during the British colonial period in order to trace the making and transformation of the contemporary category of ‘Islamic law.’ She demonstrates that not only is Islamic law not the shari’ah, its present institutional forms, substantive content, symbolic vocabulary, and relationship to state and society—in short, its politics—are built upon foundations laid during the colonial encounter. Drawing on extensive archival work in English, Arabic, and Malay—from court records to colonial and local papers to private letters and visual material—Hussin offers a view of politics in the colonial period as an iterative series of negotiations between local and colonial powers in multiple locations. She shows how this resulted in a paradox, centralizing Islamic law at the same time that it limited its reach to family and ritual matters, and produced a transformation in the Muslim state, providing the frame within which Islam is articulated today, setting the agenda for ongoing legislation and policy, and defining the limits of change. Combining a genealogy of law with a political analysis of its institutional dynamics, this book offers an up-close look at the ways in which global transformations are realized at the local level.

The image of Islam as an inherently aggressive and xenophobic religion has long prevailed in the West and can at times appear to be substantiated by current events. L. Carl Brown challenges this conventional wisdom with a fascinating historical overview of the relationship between religious and political life in the Muslim world ranging from Islam's early centuries to the present day. Religion and State examines the commonplace notion—held by both radical Muslim ideologues and various Western observers alike—that in Islam there is no separation between religion and politics. By placing this assertion in a broad historical context, the book reveals both the continuities between premodern and modern Islamic political thought as well as the distinctive dimensions of modern Muslim experiences. Brown shows that both the modern-day fundamentalists and their critics have it wrong when they posit an eternally militant, unchanging Islam outside of history. In the twentieth century Muslim countries have faced formidable political and social challenges: the struggle for independence from colonial dominance, the formation and development of independent nation states with all the pressures and problems of modernization, the Arab‐ Israeli conflict, and more recently, the emergence of the oil-producing states as a major world economic power bloc. The history of Islam in the modern period reflects the continued interaction of the Islamic tradition with the forces of change. While Islam may be acknowledged as a significant force in the precolonial period and to varying degrees during the twentieth-century independence movements, the strength and interaction of Islam in sociopolitical change has often been overlooked or underestimated. Book excerpt: Islamic theocracy is now firmly established in fundamentalist Iran, and waves of fundamentalism are sweeping the entire Islamic world, and its diaspora. This book examines the claim of those Islamists who contend that, as a belief system and a way of life, Islam carries with it a theory of politics and the state which should be applied unquestioningly. Ayubi traces both the intellectual sources and the socio-economic bases of Political Islam, arguing that it is a modern phenomenon, dating back only to the inter-war period. He describes its major proponents as urban, educated and relatively young people, whose energies were mobilised, but whose expectations were not fulfilled by the post-independence `populist' regimes in the Arab World. Islamic movements in six countries are studied in detail. Ayubi's distinctively broad definition of politics encompasses innovative material on sex and the family, and on the emerging alternative economic and social networks of Islamic banks, schools, and hospitals in the countries discussed. Ayubi stresses the traditional concern in Islam for the collective enforcement of morals, but argues that there is no case for the commonly held misconception that politics begins from theological principles in the Arab world: the historical connection between Islam and politics can be explained as an attempt by the rulers to legitimise their actions. He suggests that radical Islamists are reversing this position by subjecting politics to their specific religious views, so their movement is in some senses an anti-state one. He concludes by discussing possible intellectual responses to fundamentalism, drawing on the thinking of contemporary Muslim liberals.
