This analysis shows that most of the cases relied upon for the ‘no religious confession privilege conclusion’ are not authority for that conclusion. The origin of the privilege in the canon law in the first millennium AD is traced and its reception into common law is documented. Proof that religious confession privilege continues unbroken at common law through to the present day is of obvious importance in jurisdictions where there is no relevant statute. A correct understanding of the common law extant before statutes were passed will influence whether those statutes are broadly or narrowly interpreted. The book also brings the reader up to date on the state of religious confession privilege in the United States, Canada, England, Wales, Scotland, Ireland, Australia, New Zealand and South Africa.

Book excerpt: The appropriate regulation of the employment decisions of religious schools is an issue of great importance considering the impact that religious schools can have on the wellbeing of many individuals. Religious schools often play a central role in the lives of religious communities by providing religious education and formation to religious adherents, allowing religious adherents to fulfill spiritual and charitable obligations, and acting as a community centre for the religious community to socialise together and meet to discuss issues of mutual concern. They can also make an important contribution to the common good by developing desirable character traits in their students, employees and others involved with the school. Religious schools, however, also have the capacity to harm many individuals in the community by promoting a range of controversial theological and ethical beliefs, and denying individuals the opportunity to be included within religious schools as employees and students. The potential for religious schools to both help and harm members of the community is increasing due to the long term rise in the popularity of religious schools in Australia.The aim of this book is to assess the merits of different approaches to regulating the ability of religious schools to make employment decisions based on an employee's compatibility with the school's religion. The particular focus is on the merits of the general exception approach adopted under the Anti-Discrimination Act 1977 (NSW) that allows religious schools to make employment decisions on grounds that would otherwise be prohibited under the Act. The merits of the general exception approach are considered in relation to two alternative approaches: the inherent requirement test and the opt-in model. The inherent requirement test allows religious schools to make employment decisions on the basis of a person's compatibility with the school's religion for employment positions where a religious component is an inherent requirement. The opt-in model involves a registration process that allows religious schools to adapt the protections provided under the Anti-Discrimination Act 1977 (NSW) to the needs of each religious school.

It is not a doctrinal or empirical analysis, but a theoretical exposition of the way in which modern law has contingently drifted from its theological origins. As a result, the legal system and the ideal of individual and communal relationship it envisages is characterised by antagonism and alienation, or more broadly, violence. The book contends that the way to restore a legal community of peace is to return to a Christian theology which is informed by Trinitarian thinking or the notion of unity in diversity, and reunites faith with reason. Returning reason to its ground in being allows peaceful persuasion by the revelation of God's perfect being through the Trinity and Incarnation, which models and enables the peaceful coexistence of difference through self-sacrificing love. This in turn produces the law of love – to love your neighbour as yourself. Since love does no wrong to a neighbour, a legal community operating by the law of love can fulfil the obligations of law by going beyond merely what is required by law and love individuals as part of a community.

Book excerpt: In his recent writings on religion and secularization, Habermas has challenged reason to clarify its relation to religious experience and to engage religions in a constructive dialogue. Given the global challenges facing humanity, nothing is more dangerous than the refusal to communicate that we encounter today in different forms of religious and ideological fundamentalism. Habermas argues that in order to engage in this dialogue, two conditions must be met: religion must accept the authority of secular reason as the fallible results of the sciences and the universalistic egalitarianism in law and morality; and conversely, secular reason must not set itself up as the judge concerning truths of faith. This argument was developed in part as a reaction to the conception of the relation between faith and reason formulated by Pope Benedict XVI in his 2006 Regensburg address. In 2007 Habermas conducted a debate, under the title ‘An Awareness of What Is Missing', with philosophers from the Jesuit School for Philosophy in Munich. This volume includes Habermas's essay, the contributions of his interlocutors and Habermas's reply to them. It will be indispensable reading for anyone who wishes to understand one of the most urgent and intractable issues of our time.
