Book excerpt: The board of Peterborough and Stamford NHS Trust failed to recognize in 2007 that a PFI scheme to build a new hospital, Peterborough City Hospital, would place considerable strain on its finances for years to come. The then board compounded the decision to proceed with the scheme, which it could not afford, with a failure to monitor other changes affecting its income and costs between 2007 and 2011. In 2011-12, the in-year deficit was £46 million and the Trust is predicting an in-year deficit of more than £50 million in 2012-13. Monitor, the regulator of foundation trusts, raised well-founded concerns about the scheme's affordability with the Trust Board and the Department, however neither addressed these concerns fully before approval of the business case. Despite its earlier views, the regulator rated the Trust as a very low financial risk, reflecting its reported financial position but this risk rating did not reflect the future impact of the PFI development. Monitor had a number of opportunities to intervene before finally placing the Trust in breach of its terms in October 2011 but concluded that an intervention would not necessarily improve or change the outcome positively. The level of healthcare undertaken by the Trust is also greater than envisaged in the PFI business case, which assumed a 14 per cent drop in outpatient activity whereas this increased by 21 per cent. In addition, NHS Peterborough, the Trust's main commissioner, which has been in financial difficulty itself, has used national and local performance indicators to withhold payments for activity undertaken by the Trust

Book excerpt: The strategic management of health resources across the East of England Strategic Health Authority has failed. Ultimate responsibility for this rests with the Department of Health. For many years to come, the local community as well as the NHS and taxpayers will have to live with the consequences of separate decisions to build a new PFI hospital at Peterborough and to award a franchise to a private company to run the nearby Hinchingbrooke hospital. These decisions were taken separately despite the fact that the two hospitals are only 24 miles apart in an area where the NHS has long acknowledged that healthcare provision is running ahead of local needs. The reality is that there is not enough funding there for both Trusts to thrive as currently configured. Their financial viability will be further eroded if more people are treated outside hospitals, in line with present and past government policy. Circle Healthcare, the franchisee of Hinchingbrooke, has not achieved its expected savings in its first few months and its Chief Executive has already left. The bid was not properly risk-assessed and the successful bidder was encouraged to submit over-optimistic savings projections. The PFI deal for Peterborough and Stamford PFI hospital has proved catastrophic, with the Department now being forced to pay out nearly £1 million a week of taxpayers' money to keep the Trust afloat. Book excerpt: Although in 2011-12 there was a surplus of £2.1 billion across the NHS as a whole, there is also some financial distress, particularly in some hospital trusts. In the long term, achieving financially sustainable healthcare is likely to mean changes to how and where people access services, and some local commissioners are already consulting on and developing plans to do this. Currently, some organisations have relied on additional financial support from within the NHS. 10 NHS trusts, 21 NHS foundation trusts, and three Primary Care Trusts (PCTs) have reported a combined deficit of £356 million. There are four foundation trusts and 17 NHS trusts which between 2006-07 and 2011-12 needed injections of working capital from the Department of Health totalling £1 billion. The Department anticipates that NHS trusts and NHS foundation trusts are likely to need around £300 million more public dividend capital in 2012-13. 51 per cent of PCTs reported concern about the financial sustainability of their healthcare providers. Previously, PCTs and Strategic Health Authorities (SHAs) have been able to support otherwise weak providers. It is not yet clear whether clinical commissioning groups and the NHS Commissioning Board will agree to provide financial support to providers in this way. The NAO concludes that it is hard to see how continuing to give financial support to organisations in difficulty will be a sustainable way of reconciling growing demand for healthcare with the size of efficiency gains required within the NHS

The financial performance of NHS trusts and foundation trusts should be considered in the context of a period of little to zero growth in funding for NHS services over the last two years and during a period of significant structural change across the NHS. Measured by the total surplus or deficit of hospital trusts, financial performance for the NHS appears stronger in 2012-13 than it did in 2011-12. However, there are signs of increasing pressure. As last year, there was a substantial gap between the trusts with the largest surpluses and those with the largest deficits. When primary care trusts (PCTs) and strategic health authorities are also included, there is a similar variation between local health economies. NHS trusts in difficulty rely on cash support from the Department of Health or non-recurrent local revenue support from strategic health authorities and primary care trusts but this is not a sustainable way of reconciling growing demand with the scale of efficiency gains required within the NHS. At the end of 2012-13, there were still 100 NHS trusts that had not achieved foundation trust status. The risk that NHS trusts will not maintain their planned trajectory to foundation trust status increased substantially in 2012-13. This is a period of major transition for the NHS, as clinical commissioning groups take over from strategic health authorities and PCTs the responsibility for commissioning health services.

Book excerpt: The taxpayer has been left exposed by the failure of the Hinchingbrooke franchise according to the Public Accounts Committee's report. In February 2012, Circle took operational control of Hinchingbrooke Health Care NHS Trust, becoming the first private company to run an NHS hospital. In January 2013, the Committee expressed concerns that Circle's bid to run Hinchingbrooke had not been properly risk assessed and was based on overly optimistic and unachievable savings projections. The Department of Health responded that the NHS Trust Development Authority would monitor progress and take action if the Trust was failing to deliver on its plans to make the hospital financially sustainable. In the event, Circle was not able to make the Trust sustainable and the NHS Trust Development Authority did not take effective action to protect the taxpayer. In January 2015, Circle announced that it intended to withdraw from the contract, just three years into the 10-year franchise. It was clear at the time the franchise was let that the Trust would only survive if it secured substantial savings. The Comptroller and Auditor General's 2012 report highlighted that the savings projected in Circle's bid were unprecedented as a percentage of annual turnover in the NHS.

Book excerpt: This book challenges the World Medical Association’s (WMA) International Code of Ethics statement in 2004, which declared that ‘medical ethics in armed conflict is identical to medical ethics in times of peace’. This is achieved by examining the professional, ethical, and legal conflicts in British Military healthcare practice that occur in three distinct military environments. These are (i) the battlefield, (ii) the operational environment and (iii) the non-operational environment. As this conflict is exacerbated by the need to achieve Operational Effectiveness, this book also explores the dual loyalty conflict that Military Health Care Professionals (MHCPs) encounter between following military orders and professional codes of practice. The method used to challenge the WMA’s statement and explore these conflicts is the use of real-life problem-solving vignettes, which mirror actual ethical and professional conflicts and dilemmas that may occur in the three environments. The areas of law analysed similarly reflect the difficulties that MHCPs face when caring for the sick and wounded in violent locations when under attack. In particular, the book questions whether it is right for a MHCP to owe their patients a duty of care in hostile environments. This leads on to questioning if any MHCP could be protected by combat immunity where no duty of care is owed to fellow soldiers in the battlefield. The book also questions whether the standard of care should be variable in hostile environments. It also explores the dual loyalty conflict of a wounded senior officer refusing treatment from a junior officer. In addition, it examines the difficulties of a doctor maintaining patient confidentiality when a soldier refuses treatment for a psychological injury but wishes to redeploy to the battlefield. The book successfully challenges the WMA’s statement. It also concludes by suggesting that neither a military-focused approach nor a professional healthcare-focused approach towards military healthcare is the best way to solve the dual loyalty conflict.

The report's scope includes previously unpublished data about the number and type of complaints received by the Ombudsman in 2009-10 for every trust and strategic health authority region in England. It shows how many complaints were received and the outcomes of the complaints investigated. It reveals that 15,579 health complaints were closed by the Ombudsman in 2009-10 and that the two most common reasons for complainants to be dissatisfied with the NHS were failings in clinical care and treatment and the attitude of staff - a poor explanation or an incomplete response were the most common reasons given for dissatisfaction with NHS complaint handling. It presents a perspective not seen before: a national picture of what happens when mistakes occur and the NHS fails to put things right and highlights how often the Ombudsman needs to get involved just to ensure the NHS apologises when a mistake has been made. As the report shows, poor complaint handling can make a difficult situation worse for patients and their families. Poorly handled complaints can also escalate, creating unnecessary demands on NHS resources whilst resolving complaints effectively need not be costly. Book excerpt: The Committee investigated the provision of healthcare for the armed forces, and examined six key areas. The first was the treatment of personnel seriously wounded on operations, and the procedures for caring for them, from the point of wounding to evacuation to and treatment in the United Kingdom. The second area was the rehabilitation work for those with serious musculo-skeletal or neurological, injuries. The third was the relationship between the Ministry of Defence and the National Health Service in terms of delivering healthcare. The fourth area examined was the care for veterans and service families. The fifth issue was mental healthcare, both for service personnel and for veterans. Finally, the report examines the role of reserve personnel in the Defence Medical Services. Clinical care provided by the Defence Medical Services (DMS), in conjunction with the NHS, for personnel injured on operations is world-class. Rehabilitation work is also found to be exceptional. Services to the armed forces are delivered by the DMS, NHS, charities and welfare organisations, and this helps link the community with service personnel. The Committee would like a wider debate on which services are most appropriately provided by each sector. The Ministry of Defence's decision to base its secondary care around units embedded in NHS Trust is supported, but there is scope for more sharing of best practice between the DMS and the NHS. With veterans, the Committee is not sure adequate procedures are in place to identify veterans and to ensure priority access to services. Mental health is a vital responsibility for DMS, but a robust tracking system for veterans is needed. The reserve forces' contribution to the delivery of military healthcare is praised, but there is a danger of being overstretched.
