It collects the first results of the European Research Council Project, Scriptores iuris Romani - dedicated to a new collection of the texts of Roman jurisprudence, highlighting important methodological issues, together with innovative reconstructions of the profiles of some ancient jurists and works. Jurists were great protagonists of the history of Rome, both as producers and interpreters of law, since the Republican Age and as collaborators of the principes during the Empire. Nevertheless, their role has been underestimated by modern historians and legal experts for reasons connected to the developments of Modern Law in England and in Continental Europe. This book aims to address this imbalance. It presents an advanced paradigm in considering the most important aspects of Roman law: the Justinian Digesta, and other juridical late antique anthologies. The work offers an historiographic model which overturns current perspectives and makes way for a different path for legal and historical studies. Unlike existing literature, the focus is not on the Justinian Codification, but on the individualities of ancient Roman Jurists. As such, it presents the actual legal thought of its experts and authors: the ancient iuris prudentes. The book will be of interest to researchers and academics in Classics, Ancient History, History of Law, and contemporary legal studies.

Book excerpt: This book traces the origins, life and death of Administrative Science in Italy as an academic discipline between the nineteenth and twentieth centuries. It does so by combining the study of ideas, institutional history, intellectual history and social history. The Faculty of Law first introduced Administrative Science in 1875, with the aim of providing the elite with the necessary tools to distribute wealth more equally, to take care of the population and, thus, to make the young Italian State more legitimate in the eyes of the emerging masses. Law and social sciences were merged with the aim of increasing reforms, including that of creating a State of Happiness for all citizens. Throughout its 70-year existence, Administrative Science was deprived of its contents and scientific independence, and academically overshadowed by Administrative and Public law. Finally, although the liberal elites discarded the reformer project of Administrative Science even before Fascism turned everything upside down, most of the original traits of this knowledge were absorbed into Fascist corporate and totalitarian structures.

The teaching of Roman law and of the new papal laws, which quickly spread all over Europe, built up a professional group of lawyers and notaries which shaped the new, 'modern', public institutions, including efficient courts (like the Inquisition). Politically divided, Italy was partly unified by the legal system, so-called (Continental) common law (ius commune), which became a pattern for all of Europe onwards. Early modern Europe had for long time to work with it, and parts of it are still alive as a common cultural heritage behind a new European law system.

The approach is threefold: analysis of the academic and extra-academic scene, where economic science was elaborated and taught, the connection between economics, society and politics, and, dissemination of scientific debate. Special attention is given to the bias caused by the Fascist regime to economic debate and careers. This Volume I deals with the economics profession under Fascism, in particular in light of the political and institutional changes that the regime introduced, the restructuring of higher education, the restriction of freedom in teaching and of the press, and with respect to promoting its own strategies of political and ideological propaganda. Book excerpt: A forgotten episode of mathematical resistance reveals the rise of modern mathematics and its cornerstone, mathematical purity, as political phenomena. The nineteenth century opened with a major shift in European mathematics, and in the Kingdom of Naples, this occurred earlier than elsewhere. Between 1790 and 1830 its leading scientific institutions rejected as untrustworthy the “very modern mathematics” of French analysis and in its place consolidated, legitimated, and put to work a different mathematical culture. The Neapolitan mathematical resistance was a complete reorientation of mathematical practice. Over the unrestricted manipulation and application of algebraic algorithms, Neapolitan mathematicians called for a return to Greek-style geometry and the preeminence of pure mathematics. For all their apparent backwardness, Massimo Mazzotti explains, they were arguing for what would become crucial features of modern mathematics: its voluntary restriction through a new kind of rigor and discipline, and the complete disconnection of mathematical truth from the empirical world—in other words, its purity. The Neapolitans, Mazzotti argues, were reacting to the widespread use of mathematical analysis in social and political arguments: theirs was a reactionary mathematics that aimed to technically refute the revolutionary mathematics of the Jacobins. Reactionaries targeted the modern administrative monarchy and its technocratic ambitions, and their mathematical critique questioned the legitimacy of analysis as deployed by expert groups, such as engineers and statisticians. What Mazzotti’s penetrating history shows us in vivid detail is that producing mathematical knowledge was equally about producing certain forms of social, political, and economic order.

In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.
