Book excerpt: Le 25 juin 1998 était conclue la Convention d'Aarhus sur l'accès à l'information, la participation du public au processus décisionnel et l'accès à la justice en matière d'environnement. Cette convention, ratifiée par la Belgique, consacre une série de principes d'ordre procédural tendant à améliorer la décision publique en matière d'environnement et à accroître son effectivité, tout en apportant des éléments de réponse à ce qu'il est convenu d'appeler " le syndrome du NIMBY ". Les dispositions de la convention en la matière - ainsi que celles adoptées par la Communauté européenne dans leur foulée - contraignent les autorités belges à réexaminer et, là où test nécessaire, à revoir l'ensemble des textes normatifs régissant le processus des décisions prises par les pouvoirs publics en matière d'environnement et d'urbanisme, qu'il s'agisse de décisions de portée individuelle ou de décisions à vocation plus générale. Par ailleurs, les procédures de participation existantes donnent lieu à une jurisprudence assez abondante, qui demande à être examinée de près. Le présent ouvrage, qui constitue les actes d'un colloque organisé le 27 mai 2004 par le Centre d'étude du droit de l'environnement des Facultés universitaires Saint-Louis, tend à faire le point sur l'ensemble des questions juridiques qui se posent sur les divers aspects de cette matière, tant en ce qui concerne les procédures d'enquête publique que des procédures de participation autres.

Book excerpt: En droit de l’urbanisme et de l’environnement, la participation du public correspond aux mécanismes juridiques qui permettent aux particuliers d’influer sur l’adoption, le contenu et la mise en oeuvre des décisions administratives unilatérales relatives au cadre de vie : enquête publique, commissions consultatives, concertation, initiative, comités d’accompagnement, etc. Déjà fort ancienne, mais s’inscrivant, plus récemment, dans le mouvement de modification de la manière de « faire de l’administration » initié par la loi de 1991 relative à la motivation formelle des actes administratifs, la participation du public revêt un grand intérêt dans l’amélioration du fonctionnement de la démocratie. Son développement quantitatif et qualitatif, réclamé à cor et à cri par les particuliers et les associations de défense de l’environnement, est désormais imposé par des textes internationaux et communautaires. Sa mise en oeuvre n’est cependant pas sans entraîner certains inconvénients pratiques et sans soulever de délicates questions juridiques. Dans la première partie de l’ouvrage, l’auteur dresse de manière systématique l’état du droit positif wallon de la participation : les décisions et actes administratifs qui y sont soumis, les personnes qui peuvent participer, les procédures qu’elles doivent suivre pour le faire et les effets juridiques de leur intervention. Après avoir évoqué l’obligation de restructurer cette matière, l’auteur fournit, dans la seconde partie de l’ouvrage, les règles sur la base desquelles le droit positif devrait être contrôlé et remanié : Convention d’Aarhus, droit communautaire dérivé, droit institutionnel et des libertés publiques, droit interne. Enfin, en guise de conclusion générale, l’auteur formule, à destination du législateur et des autorités administratives compétentes, une série de propositions concrètes de modifications du droit positif de la participation.
