Book Parliaments and Post Legislative Scrutiny

Download or read book Parliaments and Post Legislative Scrutiny written by Franklin de Vrieze and published by Routledge. This book was released on 2020-12-18 with total page 220 pages. Available in PDF, EPUB and Kindle. Book excerpt: To what extent have parliaments a responsibility to monitor how laws are implemented as intended and have the expected impact? Is the practice of Post-Legislative Scrutiny emerging as a new dimension within the oversight role of parliament? What approach do parliaments apply in assessing the implementation and impact of legislation? These are the fascinating questions guiding this book. Case studies offer an in-depth look at how particular countries and the European Union conduct Post-Legislative Scrutiny. The analysis puts Post-Legislative Scrutiny in the context of parliamentary oversight and parliaments’ engagement in the legislative cycle. The purpose of this book is to demonstrate the value of Post-Legislative Scrutiny as a public good, benefiting the executive, legislature and the people in ensuring that law delivers what is expected of it, as well as to respond to the need for greater clarity as to what is meant by the term. In this way, the publication can assist legislatures to think more clearly as to what precisely they understand, and seek to achieve, by Post-Legislative Scrutiny. This book is the result of the co-operation between the Centre for Legislative Studies at the University of Hull and the Westminster Foundation for Democracy. The chapters were originally published as a special issue of The Journal of Legislative Studies.

Book Future inter parliamentary scrutiny of EU foreign defence and security policy

Download or read book Future inter parliamentary scrutiny of EU foreign defence and security policy written by Great Britain: Parliament: House of Commons: Foreign Affairs Committee and published by The Stationery Office. This book was released on 2011-01-18 with total page 24 pages. Available in PDF, EPUB and Kindle. Book excerpt: The dissolution of the Western European Union (WEU) and its Assembly in 2011 threatens to leave the EU's inter-governmental Common Foreign and Security Policy (CFSP) and Common Security and Defence Policy (CSDP) without inter-parliamentary scrutiny. The inter-governmental nature of decision-making in the CFSP and CSDP, and the significance of the CFSP and CSDP activities to which EU Member States may agree, make it important that inter-parliamentary oversight should be continued, with national parliaments taking the lead. This short Report puts forward a proposal for successor arrangements to the WEU Assembly which has been drawn up in a process of consultation among relevant Select Committee Chairs of both Houses of Parliament, with a view to putting this proposal before each House for its approval. The Report recommends that the WEU Assembly should be succeeded by an EU Inter-parliamentary Conference on Foreign Affairs, Defence and Security (COFADS). COFADS would secure continued inter-parliamentary scrutiny of this area of EU activity, would not be an autonomous institution and would minimise costs, while adding value to the work that each national parliament does on its own in this field.

Book Improving the effectiveness of parliamentary scrutiny a Select committee amendments b Explanatory statements on amendments c Written parliamentary questions

Download or read book Improving the effectiveness of parliamentary scrutiny a Select committee amendments b Explanatory statements on amendments c Written parliamentary questions written by Great Britain: Parliament: House of Commons: Procedure Committee and published by The Stationery Office. This book was released on 2011-03-09 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report builds on work undertaken in the previous Parliament. It contains three sets of recommendations which share a common aim of improving the effectiveness of parliamentary scrutiny. Firstly the Committee recommends that select committees be allowed to table in their own amendments to bills and motions on the floor of the House. Secondly it is recommended that during this Parliament Members and opposition spokespeople be encouraged to table explanatory statements on amendments to bills and that the Government use this facility to provide explanatory statements to clarify the origin of amendments and new clauses proposed on report. Thirdly the Committee recognises that whilst written parliamentary questions are a vital part of parliamentary scrutiny, there is a danger that their value is being eroded by the record numbers being tabled which also imposes significant costs on the public purse. The Committee therefore proposes a three month trial of applying a daily quota of five and an earlier deadline of 6.30 pm from Monday to Thursday and 2.30 pm on sitting Fridays to questions for written answer submitted electronically. They also recommend that, to assist Members, the Government deliver all answers to parliamentary questions to the Member concerned by email at the same time as the answer is delivered to the House

Book Comparative Multidisciplinary Perspectives on Omnibus Legislation

Download or read book Comparative Multidisciplinary Perspectives on Omnibus Legislation written by Ittai Bar-Siman-Tov and published by Springer Nature. This book was released on 2021-05-27 with total page 333 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the first in the world to provide a cross-national, comparative exploration of omnibus legislation. It contributes to the global debate over omnibus legislation and offers comprehensive, thorough and multifaceted coverage that concerns the fields of legislation and legisprudence, comparative law, political science, public policy and economics. Beyond its relevance for these fields, the book will support practitioners in parliaments, governments and courts, thereby impacting the actual use of omnibus legislation. A new, major and controversial reform is enacted in the middle of the night. It is buried in a massive omnibus bill hundreds of pages in length, which is rammed through the legislative process at breakneck speed. The legislators receive the final version of the bill in the very last minute, and protest that they’ve had no opportunity to read it in detail and know what they’re voting upon. The majority party’s legislative leaders, however, are unimpressed, and the law is eventually passed on the basis of strict party discipline. Though it may sound far-fetched, this scenario is all too familiar in many legislatures around the world. The legislative practice of combining numerous unrelated measures in one long bill, which is often passed via a highly expedited process, has become a matter of intense debate and criticism in many countries.
