Book excerpt: The Organization for Security and Cooperation in Europe (OSCE), the world's largest regional security organisation, possesses most of the attributes traditionally ascribed to an international organisation, but lacks a constitutive treaty and an established international legal personality. Moreover, OSCE decisions are considered mere political commitments and thus not legally binding. As such, it seems to correspond to the general zeitgeist, in which new, less formal actors and forms of international cooperation gain prominence, while traditional actors and instruments of international law are in stagnation. However, an increasing number of voices - including the OSCE participating states - have been advocating for more formal and autonomous OSCE institutional structures, for international legal personality, or even for the adoption of a constitutive treaty. The book analyses why and how these demands have emerged, critically analyses the reform proposals and provides new arguments for revisiting the OSCE legal framework.

Secondly, the book compares two parliamentary assemblies of international organizations – the Parliamentary Assembly of the Organization for Security and Co-operation in Europe (OSCE PA) and the Parliamentary Assembly of the Council of Europe (PACE) – in terms of structure, powers, and relations with their IGOs. It also investigates the activities of assemblies and their cooperations for the purpose to explore the positive effects of the work of international parliamentary assemblies and their potential for having an impact at the national level. Lastly, the book analyzes the tangible and desirable powers of international assemblies by comparing examples of existing international parliamentary assemblies with the UN Parliamentary Assembly project. Based on that, the author compiles a list of essential requirements and principles for effective international parliamentary assemblies.

Broadly speaking, one can differentiate between a 'classic' and a 'romantic' tradition. In modern international law, the balance between these two opposing traditions is sought in an attempt to contain or 'domesticate' the romantic version by limiting it to 'abnormal' situations, that is cases of 'alien subjugation, domination and exploitation'. This book situates Russia's engagement with the right to self-determination in this debate. It shows that Russia follows a distinct approach to self-determination that diverges significantly from the consensus view in international state practice and scholarship, partly due to a lasting legacy of the former Soviet doctrine of international law. Against the background of the Soviet Union's role in the evolution of the right to self-determination, the bulk of the study analyses Russia's relevant state practice in the post-Soviet space through the prisms of sovereignty, secession, and annexation. Drawing on analysis of all seven major secessionist conflicts in the former Soviet space and a detailed study of Russian sources and scholarship, it traces how Russian engagement with self-determination has changed over the past three decades. Ultimately, the book argues that Russia's approach to the right of peoples to self-determination should not only be understood in terms of power politics disguised as legal rhetoric but in terms of a continuously assumed regional hegemony and exceptionalism, based on balance-of-power considerations.

Book excerpt: This volume examines the role of identity formation and stages of sequencing of the steps of reconciliation – which is an enduring rather than ad an ad hoc phenomenon. RIPAR 4 asks for both the challenges to it from the domestic and international systems and the actors involved, as well as for the role of »history,« »memory« and »remembrance« either as catalysts for or obstacles to reconciliation. The analyzing of the connection among the past, the present and the future in actual or prospective reconciliation embraces all these topics and questions.Influenced by the crisis in the former Sovjet Union following the March 2014 Russian annexation/integration of Crimea and the movement of Russian soldiers into Eastern Ukraine to aid Ukrainian separatists the essays in this volume were written in 2015. »Reconciliation« is a frequently ill-defined term. As an aspiration in this volume it encompasses three senses: an incipient, thin and minimal form amounting to passive, peaceful coexistence after enmity; a more elaborate, intermediate and engaged form that is captured by the term rapprochement; and a thick or fuller form denoting active friendship, empathy, trust, magnanimity and, ultimately, amity. Beyond the definitional goal, the volume addresses ten themes. Firstly, reconciliation is being questioned as a process and/ or a terminal condition. A view is made on the requirements for the transition from conflict to a reconciliatory process, and the obstacles to beginning a process of reconciliation. Its »soft« and »hard« expressions inter alia in emotional and political dimensions are also subject of the author's interest. The observations about conflict and cooperation offered in this volume wish to add significantly to the burgeoning literature of reconciliation. These essays demonstrate that we need a variety of disciplinary and theoretical perspectives to grapple with conflict and to promote reconciliation.
