Die Abhandlung betrachtet dabei erstmals umfassend das deutsche Internationale Privatrecht der Organtransplantation unter Berücksichtigung der neuen Regelungen der Verordnung des Europäischen Parlamentes und des Rates über das auf außervertragliche Schuldverhältnisse anzuwendende Recht ("Rom II"). Die Arbeit gliedert sich im Wesentlichen in drei Teile. Im ersten Teil wird die Organentnahme vom verstorbenen und vom lebenden Spender behandelt. Dabei geht es insbesondere um die Fragen, nach welchem Recht sich die Zulässigkeit der Organentnahme bestimmt und welches Recht auf Verträge zwischen Arzt bzw. Klinik und Lebendspender anzuwenden ist. Der zweite Teil befasst sich mit den rechtlichen Beziehungen im Stadium der Organvermittlung. Dabei wird zwischen vermittlungspflichtigen und nicht vermittlungspflichtigen Organen unterschieden. Eingegangen wird auch auf Spendervereinbarungen bei der Überkreuzspende. Der dritte Teil gilt schließlich internationalprivatrechtlichen Fragen bei der Organimplantation.
