Book The Future of the International Legal Order Volume 2

Download or read book The Future of the International Legal Order Volume 2 written by Cyril E. Black and published by Princeton University Press. This book was released on 2015-03-08 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Wolfgang Friedmann, Burns H. Weston, William T. Burke, and Ivan A. Vlasic explore the new frontiers and wealth and resources that are altering the patterns of the world economy. Since rapid and dramatic technological progress poses problems that can be solved only by international or multinational controls these legal specialists emphasize the urgent need for nonviolent measures capable of reconciling the interests of the wealthy and impoverished nations and of satisfying the rising demands of the underdeveloped world for participation in the scientific revolution. The existing situation and current trends are described, and detailed recommendations to strengthen the role of international law in the decades ahead are made. Originally published in 1970. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions. Book Admissibility of Shareholder Claims Under Investment Treaties

Download or read book Admissibility of Shareholder Claims Under Investment Treaties written by Gabriel Bottini and published by . This book was released on 2020 with total page 335 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses a growing problem in international law: overlapping claims before national and international jurisdictions. Its contribution is, first, to revisit two pillars of investment arbitration, i.e., shareholders' standing to claim for harm to the company's assets and the contract/treaty claims distinction. These two ideas advance interrelated (and questionable) notions of independence: firstly, independence of shareholder treaty rights in respect of the local company's national law rights and, secondly, independence of treaty claims in respect of national law claims. By uncritically endorsing shareholder standing in indirect claims and the distinctiveness of treaty claims, investment tribunals have overlooked substantive overlaps between contract and treaty claims. The book also proposes specific admissibility criteria. As opposed to strictly jurisdictional approaches to claim overlap, the admissibility approach allows consideration of a broader range of legal reasons, such as risks of multiple recovery and prejudice to third parties.

Book Strengthening Forensic Science in the United States

Download or read book Strengthening Forensic Science in the United States written by National Research Council and published by National Academies Press. This book was released on 2009-07-29 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Scores of talented and dedicated people serve the forensic science community, performing vitally important work. However, they are often constrained by lack of adequate resources, sound policies, and national support. It is clear that change and advancements, both systematic and scientific, are needed in a number of forensic science disciplines to ensure the reliability of work, establish enforceable standards, and promote best practices with consistent application. Strengthening Forensic Science in the United States: A Path Forward provides a detailed plan for addressing these needs and suggests the creation of a new government entity, the National Institute of Forensic Science, to establish and enforce standards within the forensic science community. The benefits of improving and regulating the forensic science disciplines are clear: assisting law enforcement officials, enhancing homeland security, and reducing the risk of wrongful conviction and exoneration. Strengthening Forensic Science in the United States gives a full account of what is needed to advance the forensic science disciplines, including upgrading of systems and organizational structures, better training, widespread adoption of uniform and enforceable best practices, and mandatory certification and accreditation programs. While this book provides an essential call-to-action for congress and policy makers, it also serves as a vital tool for law enforcement agencies, criminal prosecutors and attorneys, and forensic science educators.
