Probably all of as have $2553? Lately read with interest an argument by an eloquent lady to prove the natural equality of the sexes of mankind. I pass by that question entirely. I Will assume, with that lady's opponents, Who, be it observed, are the same class of thinkers that oppose any alteration of the law of property, that men in general are superior to women in general in moral and intel lectual, as they are in muscular, force. Let us say that they have stronger bodies, stronger understandings, and stronger Wills. Should the law then, on this account, throw all its protection round the stronger party at the expense of the weaker? Those who insist most eagerly on the superior strength of men ought to feel most keenly the inequality of the law. It is idle to say that it ought to be left to the stronger to act for the common interests of the two. As long as their interests are really in common no question will arise, whatever the state of the law may be. But it cannot be denied that; in point of fact, the interests of many married couples do, in many cases, diverge. I want to know Why, in such cases, the Whole weight of the law should, so far as regards property, be on the side of the one Who already has enormous practical advantages by reason of his superior strength. Book excerpt: Excerpt from The Early History of the Property of Married Women, as Collected From Roman and Hindoo Law: A Lecture, Delivered at Birmingham, March 25, 1873 Ladies and gentlemen, - The subject to which I am about to ask your attention, however briefly and superficially it may be treated, may perhaps convey one lesson. It may serve as a caution against the lax employment of the words ancient and modern. There are few persons, I suppose, who, approaching the Settled Property of Married Women without previous knowledge of its history, would not pronounce it one of the most modern of sub jects. It has given rise to vehement controversy in our own day; some of the questions which it suggests are not yet settled; and there are many here, I dare say, who believe that they remember the first dawn of sound ideas on these questions. Yet, as a matter of fact, the discussion of the settled property of married women is one of the oldest of discussions. I do not indeed say, considering the vast antiquity now claimed for the human race, that our very first forefathers troubled themselves about the matter; but nothing can be more certain than that very soon after those divisions of mankind which were destined to ultimate greatness are seen in possession of the institution which was the one condition of their progress to civilisation - the Family - they are discerned grappling with the very same problem, no doubt in an early form, which we ourselves have hardly yet succeeded in solving. This assertion, I may observe, is less incredible to a Frenchman, or indeed to a citizen of any Continental State, than it is possibly to an Englishman. The law of the Continent on the proprietary relations of husband and wife is in the main Roman law, very slightly transmuted; and through the institutions of the Romans the history of this branch of law mayljbe traced to the earliest institutions of so much of the human race as has proved capable of civilisation. I have undertaken to illustrate my subject by the records of two great systems of law - the Roman and the Hindoo. These systems are very far indeed from being the only sources from which informa tion can be gathered concerning the infancy of mankind, or even con cerning the Aryan race of men. But the evidence supplied by each of them is highly authentic, and, while both of them run back to what may fairly be called a vast antiquity, they both assume at their starting point the existence of the institution, by no means apparently universal among savage men, out of which, as I said, all civilisation has grown - the Family. While the wife has the entire usufruct of her own property, the obligation to maintain the family rests, as before, exclusively with the husband; she also retains, inalienable, except with her own consent, her right of dower, while it is always in the power of the wife to divest, by her own act, the curtesy of the husband. But, though nothing further may be required to perfect the civil rights of married women, who remain in their own country, the position of those who, in the legitimate pursuit of their own happiness form foreign matrimonial alliances, is far different. Their marriage, according to the present law of New York, in respect to alienage, may, in the cases where, by the recent treaties of naturalization, the nationality of a married woman becomes that of her husband, operate as an absolute forfeiture of her claims to the real estate of her parents or other relatives, situate in that State, so that it will pass to the relatives of the deceased, who are citizens of the United States, however remote. At all events, if she herself be capable of taking real estate by descent or devise, her issue, if their father is a citizen or subject of any foreign country, whether the United States have or have not a natural ization treaty with it, cannot succeed to the mother's real estate in the State of New York, even though she may have inherited it from her own ancestors.
