Book excerpt: Claim-making – the everyday strategies through which citizens pursue rights fulfilment – is often overlooked in studies of political behavior, which tend to focus on highly visible, pivotal moments: elections, mass protests, high court decisions, legislative decisions. But what of the politics of the everyday? This Element takes up this question, drawing together research from Colombia, South Africa, India, and Mexico. The authors argue that claim-making is a distinct form of citizenship practice characterized by its everyday nature, which is neither fully programmatic nor clientelistic; and which is prevalent in settings marked by gaps between the state's de jure commitments to rights and their de facto realization. Under these conditions, claim making is both meaningful (there are rights to be secured) and necessary (fulfillment is far from guaranteed). Claim-making of this kind is of critical consequence, both materially and politically, with the potential to shape how citizens engage (or disengage) the state.

Book excerpt: This dissertation examines the human rights claims of two Afro-descendant communities, namely the community of Tierrabomba in Colombia and the community of Orinoco in Nicaragua. It analyzes how these human rights claims are protected in international human rights and domestic legal systems and in practice. This dissertation demonstrates that there is not one legal framework applicable to all Afro-descendant communities due to the cultural, economic, ethnic, and linguistic diversity of this population group. There is a need to tailor the nature and scope of the relevant international and domestic legal protections to the specific circumstances of the communities and their territorial States in order to adequately protect their legal claims. A locally focused approach is necessary to highlight the gaps in the different legal orders applicable to Afro-descendants and to shed light on the effectiveness of the relevant legal norms on the ground. To demonstrate this argument, this dissertation employed a multi-method approach, combining legal doctrinal research with a field study in the communities concerned. Field research revealed the communities' human rights claims and living conditions. Through the doctrinal legal research, this dissertation analyzed the exact nature and scope of the relevant international human rights provisions and their incorporation into the domestic legislations of Colombia and Nicaragua. It then compared these international and domestic legal frameworks with the realities in the communities concerned to identify any gaps in implementation.This dissertation found that the applicable international human rights law and legal systems of Colombia and Nicaragua only partially protect the human rights claims of the communities concerned, and any protection implemented on the ground is ineffective. The communities concerned demand use of their ancestral land, access to justice, and other fundamental rights to protect their community-oriented way of life. The legal analysis showed that the applicable legal norms primarily focus on the folkloric and material aspects of culture, such as unique religious rituals and traditional economic activities. This does not reflect the communities concerned's understanding of culture as a way of life. Additionally, conflicting legal norms applicable to the human rights claims of the communities concerned weaken their legal protections while domestic laws mostly lack effective remedies to enforce human rights provisions. Fear of threats of violence from non-State actors and State neglect further jeopardize the rights' implementation on the ground.To overcome these legal and practical challenges in the communities concerned, this dissertation suggests a set of recommendations for human rights scholars and practitioners. For human rights scholarship, these recommendations center around the integration of empirical research into legal studies and technical analyses of the law. Human rights practitioners should ensure effective agency of the communities concerned, adopt a more flexible understanding of culture, and strengthen local accountability mechanisms. While these recommendations are tailored to the communities concerned, they also inform human rights scholarship and practice for similarly situated communities in Latin America.

Book excerpt: This book explores how conflicts around access to water shape cities, citizenship and infrastructures by tracing how water is commodified and controlled by the Public Enterprises of Medellín (EPM), one of the most successful publicly owned utility companies in the global South. Why are water inequalities dramatically increasing in Medellín, a city that is located in an area of bountiful water resources and owns a successful, established utility company? This book explains this paradoxical situation by weaving together two central threads. The first is a critical historical analysis of the political, economic and ecological conditions that enabled the city’s utility company to grow and expand internationally, and the second is a rich account of the everyday practices and struggles of residents in low-income areas to secure access to water and demand citizenship rights. The EPM is a case of global significance as the company continues to expand its commercial operations in the Latin American services market by taking over the utilities in Panama, El Salvador and Guatemala, Mexico and Chile. Although its successful international expansion has been a source of pride and admiration for many Colombians, the implementation of market-oriented operating principles in all activities of the utility company raises important and complex questions about its public character and responsibility in the provision of basic services, which has much wider implications given how it is poised to be a model for other for-profit municipal service operations in other Latin American countries. This book advances the empirical knowledge of corporatized utilities, with a globally significant case, as well as providing new theoretical insights with which to understand the limits, challenges and opportunities faced by public utility companies to provide affordable and equal access to water in cities. This book will be of great interest to students and scholars of water resource management, corporatization, privatisation and commodification of natural resources, urban studies, citizenship and human rights, environmental sociology and Latin American studies.
