A key factor in improving accountability in achieving an entity's mission is to implement an effective internal control system. An effective internal control system helps an entity adapt to shifting environments, evolving demands, changing risks, and new priorities. As programs change and entities strive to improve operational processes and implement new technology, management continually evaluates its internal control system so that it is effective and updated when necessary. Section 3512 (c) and (d) of Title 31 of the United States Code (commonly known as the Federal Managers' Financial Integrity Act (FMFIA)) requires the Comptroller General to issue standards for internal control in the federal government.

Before issuing a final rule, agencies are generally required to publish an NPRM in the Federal Register. Agencies must then respond to public comments when issuing final rules. Agencies may use exceptions in certain circumstances to forgo this NPRM process to expedite rulemaking. The Office of Management and Budget (OMB) has authority to provide guidance on regulatory issues. GAO was asked to provide information on the rulemaking process. This report addresses (1) how often agencies issued final rules without an NPRM; (2) which exceptions agencies used to do this; and (3) whether agencies took certain actions when issuing major rules without an NPRM, including voluntarily requesting and responding to public comments. GAO reviewed a generalizable random sample of 1,338 final rules published during calendar years 2003 through 2010. The sample contained rules by 52 agencies, including all cabinet departments issuing regulations. GAO completed more detailed analyses of 123 major rules without an NPRM, including every such rule published from 2007 through 2010, to obtain additional information to answer the objectives. "

As part of the rulemaking process federal agencies must comply with an increasing number of procedural and analytical requirements. GAO was asked to examine how broadly applicable rulemaking requirements cumulatively have affected (1) agencies' rulemaking processes, in particular including effects of requirements added to the process since 2003, and (2) transparency of the Office of Information and Regulatory Affairs (OIRA) regulatory review process. To address these objectives, GAO reviewed selected rules issued between January 2006 and May 2008 and associated dockets and also interviewed knowledgeable agency and OIRA officials. GAO recommends that, consistent with internal control standards, the Environmental Protection Agency (EPA), Food and Drug Administration (FDA), and Securities and Exchange Commission (SEC) track and evaluate actual performance versus targeted milestones for developing significant rules to identify process improvement opportunities. GAO also recommends that OMB should provide additional guidance to agencies to improve transparency and documentation of the OIRA review process.

[...] The group's discussions and recommendations were informed not only by recent experiences with the Bush administration, but by the long-brewing troubles many observers had grown frustrated with: the complexity of the process, the length of the typical rulemaking, access by special interests, the difficulty the public faces in engaging in the process, and the integrity and quality of regulatory deci. [...] The American Bar Association (ABA) has submitted to the administration a report calling for an overhaul of the current e-rulemaking system, both the "backend," the Federal Docket Management System (FDMS), and the online public portal, Regulations.gov. [...] The PRA was written long before the development of the Internet and modern computer technologies, and its implementation, and the law itself, must be brought into the 21st century.22 We urge Congress to consider a substantial revision of the PRA, refocusing it to be about managing information resources. [...] To fully understand the regulatory process and the reforms necessary to improve its inner workings, one must look not only at OIRA and the cross-cutting policies that govern the system but at the agencies' ability to carry out the tasks asked of them.
