Book Aboriginal Consultation Environmental Assessment and Regulatory Review in Canada

Download or read book Aboriginal Consultation Environmental Assessment and Regulatory Review in Canada written by Kirk N. Lambrecht and published by University of Regina Press. This book was released on 2013 with total page 209 pages. Available in PDF, EPUB and Kindle. Book excerpt: Supreme Court of Canada decisions have defined a general framework for the "duty to consult" Aboriginal peoples and accommodate their concerns over natural resource development, but anticipate the details of that framework will be expanded upon in the future. Aboriginal Consultation, Environmental Assessment, and Regulatory Review in Canada offers a paradigm that advances that discussion. It proposes an integrated and robust planning model for natural resource extraction allowing Aboriginal peoples, industry, governments, tribunals, and the Courts to all make contributions to reconciliation in the context of sustainable development and environmental protection. Kirk Lambrecht surveys the law of actual and asserted Aboriginal rights and historical and modern Treaty rights in Canada and discusses the national and international purposes of environmental assessment and regulatory review. He appraises the fundamental principles of Supreme Court of Canada jurisprudence defining aboriginal consultation and accommodation as a constitutional imperative and uses case studies involving the National Energy Board to demonstrate how integrated process has evolved over time. Finally he offers general conclusions on the practical utility, and outstanding challenges, involving an integrated planning paradigm.

This book was released on 2010 with total page 82 pages. Available in PDF, EPUB and Kindle. Book excerpt: A group of companies asked the National Energy Board (NEB) to approve their proposal to develop three natural gas fields in and near the Mackenzie Delta. They would also build pipelines to ship the natural gas and natural gas liquids south to markets. Together these three proposals are called the Mackenzie Gas Project. This set of two volumes presents the response of the NEB. Volume 1 first describes the project as a whole and some of the factors assessed in determining whether it would be in the public interest. It then looks more closely at the natural gas fields, gathering pipelines and processing facilities in the Mackenzie Delta region. Finally, it outlines the decision reached by the NEB. Volume 2 describes how the project would be built, operated and regulated.--Includes text from document.

Download or read book Quarrying Permit Application for the Mackenzie Gas Project on Crown Lands Within the Inuvialuit Settlement Region and Gwich in Settlement Area written by and published by . This book was released on 2006 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: "This is an application for quarrying permits under Section 12 of the Territorial Quarrying Regulations. It is being submitted to Indian and Northern Affairs Canada (INAC), pursuant to Section 8 of the Territorial Lands Act, by Imperial Oil Resources Ventures Limited (Imperial). The activities in this application pertain to the borrow sites that will be required in the Inuvialuit Settlement Region (ISR) and Gwich'in Settlement Area (GSA) on Crown land in the Northwest Territories for the Mackenzie Gas Project (the project). The map listed in Appendix C shows the proposed Crown borrow sites in the ISR and GSA. The application is intended to permit removal of material from each borrow site for the period of time indicated for each site (see Table 1-5 and Table 1-6). This application is part of a suite of applications that are being submitted by Imperial which include: applications to the Inuvialuit Land Administration (ILA), and Indian and Northern Affairs Canada (INAC) for land use activities in the ISR; applications to the National Energy Board (NEB) to permit the construction and operation of the gathering system and a natural gas transmission pipeline; for the project; land use applications to the Mackenzie Valley Land and Water Board (MVLWB) for development activities in the Mackenzie Valley; applications to the Inuvialuit Land Corporation and Gwich'in Tribal Council to permit borrow site activities in the ISR and GSA on private land; applications to the Gwich'in Land Use Planning Board (GLUPB) for an amendment and an exception to the approved land use plan for the GSA. In addition to the applications, an environmental impact statement (EIS) has been filed with the Joint Review Panel (JRP) for the project. The EIS addresses the biophysical and human environment aspects of the entire project, including this application. ... Some of the proposed borrow site development activities located in the GSA will take place on lands that have been designated for special management in the Nành' Geenjit Gwitr 'it Tigwaa 'in, Working for the Land - The Gwich'in Land Use Plan dated August 2003 (Gwich'in land use plan). Development of three borrow sites in the Transportation Special Management Zone - Dempster Highway: Mackenzie River to Inuvik (the special management zone), will require approval of an exception to the Gwich'in Land Use Plan. Accordingly, an application for an exception has been submitted to the Gwich'in Land Use Planning Board to address a visibility condition in the plan. The exception application will be amended to reflect all three borrow sites. ... A memorandum of understanding (MOU) has been reached between INAC and the IRC regarding the management of granular resources on private and Crown land in the ISR. The MOU sets out the broad outline for how granular resources should be managed in the region. It describes how the needs of communities, and other regional priorities, relate to the needs of industry"--Introd.
