  • Publisher : Harvard University Press
  • Release : 2006-04-15

  • Pages : 328 pages

Download or read book Justice in Robes written by Ronald Dworkin and published by Harvard University Press. This book was released on 2006-04-15 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: How should a judge’s moral convictions bear on his judgments about what the law is? Lawyers, sociologists, philosophers, politicians, and judges all have answers to that question: these range from “nothing” to “everything.”In Justice in Robes, Ronald Dworkin argues that the question is much more complex than it has often been taken to be and charts a variety of dimensions—semantic, jurisprudential, and doctrinal—in which law and morals are undoubtedly interwoven. He restates and summarizes his own widely discussed account of these connections, which emphasizes the sovereign importance of moral principle in legal and constitutional interpretation, and then reviews and criticizes the most influential rival theories to his own. He argues that pragmatism is empty as a theory of law, that value pluralism misunderstands the nature of moral concepts, that constitutional originalism reflects an impoverished view of the role of a constitution in a democratic society, and that contemporary legal positivism is based on a mistaken semantic theory and an erroneous account of the nature of authority. In the course of that critical study he discusses the work of many of the most influential lawyers and philosophers of the era, including Isaiah Berlin, Richard Posner, Cass Sunstein, Antonin Scalia, and Joseph Raz.Dworkin’s new collection of essays and original chapters is a model of lucid, logical, and impassioned reasoning that will advance the crucially important debate about the roles of justice in law.

Download or read book On Law and Justice written by Alf Ross and published by The Lawbook Exchange, Ltd.. This book was released on 2004 with total page 396 pages. Available in PDF, EPUB and Kindle. Book excerpt: Ross, Alf. On Law and Justice. Berkeley: University of California Press, 1959. xi, 383 pp. Reprint available December 2004 by the Lawbook Exchange, Ltd. ISBN 1-58477-488-6. Cloth. $90. * In this influential and oft-cited study Ross discounted the theories of natural law, positivism and legal realism. In their stead, he proposed the abandonment of "ought-propositions" for the "is-propositions" employed by other empirical sciences, thereby envisioning lawyers that serve merely as "rational technologists." Less bound by tradition, and traditional notions of justice, jurisprudence then becomes "not only a beautiful mental activity per se, but also an instrument which may benefit any lawyer who wants to understand what he is doing and why" (Preface).

Book The Unconscious as Infinite Sets

Download or read book The Unconscious as Infinite Sets written by Ignacio Matte Blanco and published by Routledge. This book was released on 2018-03-29 with total page 462 pages. Available in PDF, EPUB and Kindle. Book excerpt: A systematic effort to rethink Freud's theory of the unconscious, aiming to separate out the different forms of unconsciousness. The logico-mathematical treatment of the subject is made easy because every concept used is simple and simply explained from first principles. Each renewed explanation of the facts brings the emergence of new knowledge from old material of truly great importance to the clinician and the theorist alike. A highly original book that ought to be read by everyone interested in psychiatry or in Freudian psychology.
