Book excerpt: This volume, first published in 1977, brings together eleven studies of crime and the administration of the criminal law in England during the early modern period. They represent a variety of approaches – legal, historical and sociological – to the study of historical crime. The initial essay in this study, which is written from a legal standpoint, is the first coordinated account of the structure of criminal law administration in this formative period. It is followed by investigations into the nature and incidence of crime, court appearance and punishment, separate studies of witchcraft, infanticide and poaching, and an account of conditions in eighteenth-century Newgate. This book will be of particular interest to students of criminology and history.

  • Author : Holly Brewer
  • Publisher : UNC Press Books

  • Pages : 407 pages

Download or read book By Birth or Consent written by Holly Brewer and published by UNC Press Books. This book was released on 2012-12-01 with total page 407 pages. Available in PDF, EPUB and Kindle. Book excerpt: In mid-sixteenth-century England, people were born into authority and responsibility based on their social status. Thus elite children could designate property or serve in Parliament, while children of the poorer sort might be forced to sign labor contracts or be hanged for arson or picking pockets. By the late eighteenth century, however, English and American law began to emphasize contractual relations based on informed consent rather than on birth status. In By Birth or Consent, Holly Brewer explores how the changing legal status of children illuminates the struggle over consent and status in England and America. As it emerged through religious, political, and legal debates, the concept of meaningful consent challenged the older order of birthright and became central to the development of democratic political theory. The struggle over meaningful consent had tremendous political and social consequences, affecting the whole order of society. It granted new powers to fathers and guardians at the same time that it challenged those of masters and kings. Brewer's analysis reshapes the debate about the origins of modern political ideology and makes connections between Reformation religious debates, Enlightenment philosophy, and democratic political theory.

Book The Law Emprynted and Englysshed

Download or read book The Law Emprynted and Englysshed written by David John Harvey and published by Bloomsbury Publishing. This book was released on 2015-04-30 with total page 688 pages. Available in PDF, EPUB and Kindle. Book excerpt: What impact did the printing press – a new means of communicating the written word – have on early modern English lawyers? This book examines the way in which law printing developed in the period from 1475 up until 1642 and the start of the English Civil War. It offers a new perspective on the purposes and structures of the regulation of the printing press and considers how and why lawyers used the new technology. It examines the way in which lawyers adapted to the use of printed works and the way in which the new technology increased the availability of texts and books for lawyers and the administrative community. It also considers the wider humanist context within which law printing developed. The story is set against the backdrop of revolutionary changes in English society and the move not only to print the law, but also increase its accessibility by making information available in English. The book will be of interest to lawyers and legal historians, print and book historians and the general reader.

Book A Modern Legal History of Treasure

Download or read book A Modern Legal History of Treasure written by N.M. Dawson and published by Springer Nature. This book was released on 2023-04-06 with total page 639 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines treasure law and practice from the rise of the new science of archaeology in the early Victorian period to the present day. Drawing on largely-unexamined state records and other archives, the book covers several legal jurisdictions: England and Wales, Scotland, Ireland pre- and post-independence, and post-partition Northern Ireland. From the Mold gold cape (1833) to the Broighter hoard (1896), from Sutton Hoo (1939) to the Galloway hoard (2014), the law of treasure trove, and the Treasure Act 1996, are considered through the prism of notable archaeological discoveries, and from the perspectives of finders, landowners, archaeologists, museum professionals, collectors, the state, and the public. Literally and metaphorically, treasure law is revealed as a ground-breaking chapter in the history of the legal protection of cultural property and cultural heritage in Britain and Ireland.
