Book excerpt: In Well-Being: Happiness in a Worthwhile Life, Neera K. Badhwar offers a new argument for the ancient claim that well-being as the highest prudential good - eudaimonia - consists of happiness in a virtuous life. Virtue is a source of happiness, but happiness also requires external goods. The argument takes into account recent work on happiness, well-being, and virtue, and defends a neo-Aristotelian conception of virtue as an integrated, but limited, intellectual-emotional-action disposition. These conceptions of well-being and virtue are argued to be widely-held and compatible with experimental psychology. Badhwar's main argument for the thesis that well-being as the highest prudential good requires virtue is as follows: (i) well-being as the highest prudential good requires an objectively worthwhile life; (ii) such a life entails realism as a character trait; (iii) realism entails a life of virtue; (iv) hence well-being as the highest prudential good requires a life of virtue. A realistic person understands important aspects of her own life and human life in general, and is disposed to act on her understanding. Her understanding springs from her autonomy and reality-orientation, i.e., her disposition to think for herself and seek truth or understanding. But the demands of virtue in the face of our emotional and cognitive limitations make complete virtue impossible, and this is one reason why complete well-being is also impossible.

However, the presumption of innocence creates a number of practical and theoretical issues, particularly regarding pre-trial and post-trial processes. In Taming the Presumption of Innocence, Richard L. Lippke argues that the presumption of innocence should be contained to the criminal trial. Beyond the realm of the trial, legal professionals, investigators, and the general public should carry out their respective roles in the criminal justice process without making any presumptions about guilt or innocence whatsoever. Rather than eschewing the significance of the presumption of innocence, the book defends its role within its proper context, the criminal trial. According to Lippke, other aspects of the criminal justice system such as investigation, lawmaking, and treatment of ex-offenders should be conducted in such a way that reflects the fallibility and unpredictability of the system without involving the issue of presumed guilt or innocence. Book excerpt: This book explores representations of child autonomy and self-governance in children’s literature.The idea of child rule and child realms is central to children’s literature, and childhood is frequently represented as a state of being, with children seen as aliens in need of passports to Adultland (and vice versa). In a sense all children’s literature depends on the idea that children are different, separate, and in command of their own imaginative spaces and places. Although the idea of child rule is a persistent theme in discussions of children’s literature (or about children and childhood) the metaphor itself has never been properly unpacked with critical reference to examples from those many texts that are contingent on the authority and/or power of children. Child governance and autonomy can be seen as natural or perverse; it can be displayed as a threat or as a promise. Accordingly, the "child rule"-motif can be seen in Robinsonades and horror films, in philosophical treatises and in series fiction. The representations of self-ruling children are manifold and ambivalent, and range from the idyllic to the nightmarish. Contributors to this volume visit a range of texts in which children are, in various ways, empowered, discussing whether childhood itself may be thought of as a nationality, and what that may imply. This collection shows how representations of child governance have been used for different ideological, aesthetic, and pedagogical reasons, and will appeal to scholars of children’s literature, childhood studies, and cultural studies.

It explains that the presumption should be seen as reflecting notions of moral comfort around judgment of others. Specifically, when one is asked to make a judgment about the guilt or otherwise of a person accused of wrongdoing, the default position should be to do nothing. This reflects the very serious consequences of what we do when we decide someone is guilty of wrongdoing and is not a step to be taken lightly. Traditionally, decision makers have only taken it when they are morally comfortable with that decision. It then documents how legislators in a range of common law jurisdictions have undermined the presumption of innocence, through measures such as reverse onus provisions, allowing or requiring inferences to be made against an accused, redefining offenses and defenses in novel ways to minimize the burden on the prosecutor, and by dressing proceedings as civil when they are in substance criminal. Courts have too easily acceded to such measures, in the process permitting accused persons to be convicted although there is reasonable doubt as to their guilt, and where they are not guilty of sufficiently blameworthy conduct to attract criminal sanction. It finds that the courts must be prepared to re-assert the prime importance of the presumption of innocence, only permitting criminal sanctions to be imposed where they are morally certain that the accused did that of which they have been accused, and morally comfortable that the conduct being addressed is worthy of the kind of criminal sanction which prosecutors seek to impose. Courts must be morally comfortable about the finding of guilt, and the imposition of the criminal penalty in a given case. They have lost sight of this moral underpinning to criminal law process and substance, and it must be regained.

Large numbers of people are now characterized and characterize themselves as sufferers of psychological injury caused by the actions of others. In contrast with the familiar critiques of victim culture, Accounts of Innocence offers a new and empirically rich perspective on the question of why we now place such psychological significance on victimization in people's lives. Focusing on the case of adult survivors of childhood sexual abuse, Joseph E. Davis shows how the idea of innocence shaped the emergence of trauma psychology and continues to inform accounts of the past (and hopes for the future) in therapy with survivor clients. His findings shed new light on the ongoing debate over recovered memories of abuse. They challenge the notion that victim accounts are an evasion of personal responsibility. And they suggest important ways in which trauma psychology has had unintended and negative consequences for how victims see themselves and for how others relate to them.
