The federal government has plans, now, to follow suit with regional coastal and marine spatial plans. To be successful, state and federal governments must cooperate.

At the same time competition for space has intensified, affecting marine life and people's livelihoods. Much has been written about marine management using marine protected areas, but MPAs are only a small subset of spatial management tools available. MPAs and MPA networks are better seen as starting points for more comprehensive spatial management, facilitated by ocean zoning. This logical scaling up from discreet piecemeal protected areas to larger and more systematic planning is happening around the world, but few are aware that we are entering a brave new world in ocean management with zoning at its core.This book provides guidance on using ocean zoning to improve marine management. Book excerpt: Although coastal zone management certainly incorporates the adjacent seas, during the first decades of the Coastal Zone Management Act of 1972 (CZMA) states directed most policy development and management efforts to the landward side of the coastal zone where the most immediate conflicts and needs arose. At the federal level, even extension of a 200-mile Exclusive Economic Zone (EEZ) in 1983 led to little or no change in ocean policy or ocean management. The seas were undoubtedly becoming more intensely used for both living and non-living resource development, but the United States dealt with these issues primarily through legal regimes addressing single sectors, such as offshore oil and gas development or fisheries management. Today ocean uses are intensifying, raising user conflicts and stressing ocean resources and ocean systems more than humanity was considered capable of doing a century ago. Tragedies like the BP oil spill demonstrate the widespread effects of a single ocean use across all sectors of ocean and coastal activities and on the ecosystems upon which these sectors rely. Management of today's oceans requires rational development of ocean policies, priorities, and governance structures. On July 19th, 2010, President Obama established the first United States national ocean policy, creating federal framework for implementing ocean policy and planning. For states that have taken significant steps toward planning and management of ocean waters within their boundaries, coastal and marine spatial plans potentially provide new opportunities for assuring that development and activities in the federal offshore will adequately considers state policies and priorities. For other states, like Florida, that have not developed comprehensive coastal and marine policy and planning, national ocean policy development may mean weak participation in the regional planning process, loss of state prerogative concerning major coastal planning issues and a fundamental failure in the governance of the states in regard to their coasts and waters. This article looks at the historical development of state ocean policy development, including the motivations of coastal states to take steps to develop comprehensive state ocean policy. Next the article addresses why “now” is the critical time for state ocean policy development. Finally, the article addresses the guiding principles for Florida's ocean policy development.

The proposed plan has been constructed in light of the changing ocean jurisdiction framework brought about by the Third U.N. Law of the Sea Conference and the continuing realignment of Federal-State relationships. The objective of this planning effort was to design an efficient procedure for coordinating existing and future ocean uses and management programs, while simultaneously minimizing economic and political costs. Current and future marine uses of the Gulf of Maine are examined and described in the study. The plan proposes establishment of a Federal level Marine Affairs Council, within the Executive Office of the President, and formation of a Regional Ocean Management Council for the Gulf of Maine. The Marine Affairs Council would be composed of all relevant Executive branch department/agency heads and, would be chaired by the Vice-President. The Regional Ocean Management Council would be composed of Governors from adjacent States, regional Executive branch administrators, and a Presidential appointee and, would be open to participation from the marine user community. The study recommends that the proposed plan be implemented by legislative initiative or by Executive Order of the President. The roles of the U.S. Coast Guard in the proposed regional and Federal ocean management bodies are discussed in view of the current resource shortages being faced by this marine service agency.

Book excerpt: The management of common pool resources and publicly-owned areas is fraught with difficulty. This book explores the long, complex, and frequently contentious history of public lands management in the United States in order to draw lessons for the emerging field of marine spatial planning (MSP). The author first establishes that these two seemingly different settings are in fact remarkably similar, drawing on established theories of policy analysis. The work then examines the management of US National Forests over the past 120 years, including three place-based case studies, to discover recurring themes. The analysis shows how different management approaches evolved over time in response to changing laws and cultural norms, producing outcomes favored by different constituencies. This history also reveals the ambiguities and contradictions inherent in multiple-use management of any public space. Next, the book analyzes recent efforts to advance MSP, both in the US and globally, showing how they mirror past experiences in National Forest management, including similar disagreements among stakeholders. In conclusion the author suggests how those within ocean-related sectors – government, academia, industry, and environmental groups – might achieve their individual and collective goals more effectively based on lessons from the public lands setting.
