With his focus on the nineteenth century, Ramos begins his genealogy of an emerging Latin Americanism with an examination of Argentinean Domingo Sarmiento and Chilean Andrés Bello, representing the “enlightened letrados” of tradition. Ever since the Germany-Pakistan BIT of 1959, almost every investment agreement has included an FPS clause. FPS claims refer to the most diverse factual settings, from terrorist attacks to measures concerning concession contracts. Still, the FPS standard has received far less scholarly attention than other obligations under international investment law. Filling that gap, this study examines the evolution of FPS from its medieval roots to the modern age, delimits the scope of FPS in customary international law, and analyzes the relationship between FPS and the concept of due diligence in the law of state responsibility. The former covers three topics: (a) the categories of speaker and hearer as opposed to the category of nonparticipants in the speech act; (b) the interactional roles of speaker and hearer as defined by the illocutionary point of the speech act and the preconditions underlying its successful performance; (c) the decomposition of the speech act as a model for describing strategies in verbal interaction. The object of the descriptive part of this study is to survey the different realizations of the categories of speaker and hearer reference and the strategic effects speakers intend to bring about by employing them. For this purpose, a language-specific analysis is applied to the system of speaker and hearer reference in Peninsular Spanish. For the sake of homogeneity, Peninsular Spanish is also chosen as the object language for the discussion of the general language phenomena which are treated in the theoretical discussion.

Now, the fifth volume, has become available, covering the years from 1861 to 1899.
