Download or read book Judicial Review of Administration in Europe written by Giacinto Della Cananea and published by Oxford University Press. This book was released on 2021 with total page 417 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is about judicial review of public administration. Many have regarded this to divide European legal orders, with judicial review of administrative action in the general courts or specialized administrative courts, or with different distance from the executive. There has been considerably less of comparison of the basic procedural and substantive principles. The comparative study in this book of procedural fairness and propriety in the courts reveals not only differences but also some common and connecting elements, in a 'common core' perspective. The book is divided into four parts. The first explains the nature and purpose of a comparison to understand the relevance and significance of commonality and diversity between the legal systems of Europe, and which considers other legal systems which are distant and distinct from Europe, such as China and Latin America. The second part contains an overview of the systems of judicial review in these legal orders. The third part, which is the heart of the 'common core' method, contains both a set of hypothetical cases and the solutions, according to the experts of the legal systems selected for our comparison, to the cases. The fourth part serves to examine the answers in comparative terms to ascertain not so much whether a 'common core' exists, but how it is shaped and evolves, also in response to the influence of supranational legal orders as the European Union and the Council of Europe.

Download or read book Wood and Wood Joints written by Klaus Zwerger and published by Birkhauser Architecture. This book was released on 2012 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: Building with wood as an ecologically viable material is a tradition with a long history. The timber architecture which has ensued over the past centuries reveals to the modern observer the depth of knowledge which has enabled both Eastern und Western cultures to use this wonderful material in such a creative way. In the most typical method of building with wood, elements are connected by using wood joints which do not require the assistance of adhesives or metal connectors. This art of wood jointing reached its zenith in Japan; but Europe too provided its share of highly influential forms. By looking at several hundred examples from Japan and 18 European countries, with a new chapter on China added to this enlarged edition, this book describes in great detail the history of timber architecture in terms of its technical, aesthetic and ecological dimensions. This thorough study is a mine of information to specialists in this field; it opens up to the craftsman of today what has become an almost forgotten world and provides a fascinating account for the general reader. Here is a man who has trekked though the wild Carpathian forests, the Norwegian outback, the Russian steppes and obscure regions of Japan in pursuit of the wood joint. He tells the story with a sense of unfolding discovery; for anyone interested in how buildings work this book is a joy to read." the architects journal"

Download or read book The Laws of Transparency in Action written by Dacian C. Dragos and published by Palgrave Macmillan. This book was released on 2018-08-07 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the issue of free access to information as part of the openness and transparency principles. The free access to public information has become one of the most hotly contested aspects of contemporary government and public administration. Many countries in Europe have well-established Freedom of Information laws (FOIAs), while others have adopted them more recently. The problems that occur in the implementation of FOIAs are different due to the legal and institutional context; nevertheless, patterns of best practices and malfunctioning are comparable. The book analyses in comparative and empirical perspective the respective main challenges. Whilst the existing literature focusses on the legal provisions, this book offers practical insights through 13 national profiles and the EU level, on how effective the legal provisions of FOIAs really prove to be.
Download or read book Codification of Administrative Procedure written by Jean-Bernard Auby and published by Primento. This book was released on 2013-11-27 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law on administrative procedure regulates the processes through which administrative decisions and administrative projects are elaborated. It is more and more regarded as essential in administrative laws: it is really considered as the central part of it in some systems. In many jurisdictions, rules concerning administrative procedure are codified, gathered in a single piece of general legislation: in a few, it remains non codified. The book is made of the different contributions presented on the topic to the last congress of the International Academy of International Law (Taipei, 2012): national reports on twenty countries and a general report. These contributions examine the way administrative procedure became codified, the obstacles which had to be overcome, the main orientations of the codes, their evolution in time; alternatively, they explain why administrative procedure is not codified. Providing extensive materials on an issue which is a concern in many administrative laws and many administrative systems, the book is intended for all searchers and experts in administrative law and public management, whether academics or practitioners.
Download or read book European Administrative Law in the Constitutional Treaty written by Eva Nieto-Garrido and published by Bloomsbury Publishing. This book was released on 2007-10-09 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents an integrated approach to general questions of European administrative law and offers some possible solutions to the problems which it poses, the Treaty establishing a Constitution for Europe being the point of reference. Under the Treaty general questions of administrative law are no longer addressed merely in a fragmented or incidental way but as a discipline that governs the exercise of sovereign powers by a supranational entity. This calls for a detailed examination of the fields which comprise European administrative law and the book therefore examines in some detail the key areas of rulemaking powers and normative instruments, the implications of the Charter of Fundamental Rights for European and national administrations, administrative procedure, and judicial protection within the European Union. The Foreword to the book is written by Professor Carol Harlow.
