Hemingray. and Hemingray & Co., that the amount due on said note should be considered and treated as a. loan_ by Homans to the firm on call, the note being retained merely as evidence and security. _ ' By this transaction, in equity, the firm of Hemingray 8: C0. became the principal debtors, and Hemingray's individual liability on the note became and continued merely a collateral security; and the surety, being sued, clearly has a right to set up, by way of defense, whatever would be a bar to the suit, if it had been brought against the principal.
